Hi

I have been in a defacto relationship since nov 2021 but living together for longer.


I just got an letter from Ato saying i have to payback medicare levy for 2022 tax return as i was not exempt from it even if i had no access to medicare benefits as estated in the MES until March 2022.


Is my partner a dependant spouse even if i dont mantain him? What makes him a dependant?

Your spouse is a dependant for medicare levy. This includes if they worked themselves. We have info about dependants on our website via the link.


To be exempt under the category you specified, your spouse also needs to be in an exemption category. If they weren't this could be why we've sent you a letter.
