Has anyone heard of a special deal by the government with overseas companies that allow them to trade within Australia without an ABN?

im trying to get a refund from a company that are trading within Australia without an ABN but apparently the government have allowed them some special thing were they can make a **bleep** load of CASH (no eftpos available) trading in Australia WITHOUT an ABN, therefore making it difficult for me to submit a complaint to the Dep Of Fair trade as apparently I need this ABN.

Can someone please let me know what this special grant is? 

Or are the tradeshow that allowed this to happen telling me a load of **bleep**?

Companies that aren't located within Australia may still be entitled and required to have an ABN where :

 

  • It's carrying on an enterprise in Australia, and
  • In the course of carrying on an enterprise, it makes sales that are connected with Australia

If you're a business and you are trading with an overseas business that doesn't have an ABN you'll need to withhold tax at a higher rate and submit that to us on their behalf.

 

If you are a consumer and you are dissatisfied with the service you've received from this company you may also be able to lodge a complaint with the Australian Competition and Consumer Commission.
