Does an employee have to earn to Jobkkeper allowance

I know of someone who was eligible for the job keeper allowance as at 1st of March and was working as a casual on call for a labour hire firm (earned approx. $30,000 last year). Toward the end of March she was advised their was insufficient work and gave her a termination of her contract. A few weeks later they contacted her and advised she was eligible and sent her the forms to fill in. During April and May she continued working for them and worked approx. 10 days (about one day per week).

 

Now they have contacted her and advised she was not eligible for job keeper as she had been terminated and have given her a letter to sign to cancel the termination contract at the end of March so she has a continuation of contract and can keep the job keeper. But they are also asking her to work off over 50 days (the equivalent of working 2 days per week) without pay that she owes them for being on job keeper even though there was no work. Can they make her do work off her job keeper.

All this is illegal - if she was not eligible for Jobkeeper, the employer needs to contact ATO to make arrangements to return the amount received - heavy penalties for doing it any other way

But she was eligible... She met all the criteria. They are saying it was an administrative error that they gave her an termination notice. The query is about making her do 50 hours in lieu now for the days in May to July to make up for no days of work.
