Early release of super

My son has had his hours reduced by 50% but he has been forced to use his annual leave to make up his normal hours. Does he need to wait until his annual leave is all gone before he can apply? I figured he would qualify straight away as annual leave hours are not ‘working hours’, is this correct?

Thanks for reaching out to ATO Community.

 

To be eligible for early release of super you must meet the eligibility requirements.

 

If working hours are reduced by 20% or more (including to zero), you will be eligible to access your super early even if your salary remains the same.

 

Looks like he meets the 20% more reduction to working hours. Using annual leave as a top-up doesn't make him ineligible provided working hours have been reduced by 20% or more.
