Hi,

 I have a parttime employee on Jobkeeper payment asking for working hours to be reduced (5 days to 2 days, and used to work 5days before covid19) so he can work on a second job for extra income. So I will have to employ an extra staff to cover the gap. Is he still eligible for Jobkeeper payment ?

Is it fair or meet the purpose of the Jobkeeper scheme?

The employee will still be eligible as employees are able to gain additional employment while on JobKeeper as long as they maintain a working relationship with their original employer. Regarding your employee asking for reduced hours, we suggest you visit Fair Work Australia for more information on your rights as an employee.

His normal hours (including regular overtime) are not likely to completely restore before the conclusion of his stand down period. Taking this into account, together with the possibility that his hours could be altogether reduced should there be an unwelcome sudden cancellation of a racing event due to COVID-19, section 789GDC(1)(c) was made out.

Further, the FWC concluded that the JobKeeper enabling stand down was reasonable having regard to (amongst other things) the overall impact of COVID-19 on the operations of Live Events and its obligations to act in the best interests of all its employees to redistribute available work.
