JobKeeper Eligibility with subclass 444 visa

We have an employee who left Australia on 27 Feb to work in our NZ office, followed by a holiday in NZ. Because she departed Australia, her subclass 444 visa was automatically cancelled.

 

She is now working from NZ because the borders closed whilst she was on holidays. She is considered an Australian resident for tax purposes, is still working for us and being paid by the Aust payroll. As she hasn't yet returned, she isn't in receipt of a subclass 444 visa. Would she still be eligible for JobKeeper because she isn't an Australian citizen or PR, but technically doesn't have a subclass 444 visa because she was out of the country.

Doenst look like shes eligible if the visa was cancelled prior to 1 March 

 

at 1 March were either  

  • an Australian resident (within the meaning of the Social Security Act 1991) – visit the Services Australia website and read residence descriptionsExternal Link for more details
  • an Australian resident for the purpose of the Income Tax Assessment Act 1936 and the holder of a Subclass 444 (Special Category) visa as at 1 March 2020
