Hi,

We are a tourism business operating in FNQ and qualified for JobKeeper in March and are still eligible.

We have an employee who has worked for us for 10 years and was eligible for JobKeeper as he is both a resident for Tax Purposes and on a SCV 444 Visa as he is from NZ.

He had to go home suddenly due to a family emergency and is now stuck there due to the Covid border restrictions.  His intention was to be away only for a short time and to return to work with us as he is a valued member of our staff.

Due to the situation, does he still qualify or meet the criteria for JobKeeper.

We have noted other examples here that suggest he does as long as he remains connected to us, his employer.

Could you please confirm that we are doing the right thing by continuing to claim and pay him JobKeeper.

Thank you any advice would be appreciated.

Hi @SteveY,

As long as your employee meets all the criteria for the 1 July test, you can continue claiming the JobKeeper payment for them.

Hi RenATO,

Thankyou for your prompt response, it is much appreciated to know that we are doing the right thing.  Hopefully he can return soon as his experience and knowledge of our property is very much missed.

May I ask another related question please.

As he isn't able to work, could you please confirm that we dont need to pay SGC on the JobKeeper payment.  I have seen a reply from JacquelineATO (Link below) that says we don't but want ot confirm under our circumstances as we dont want to not meet our SGC obligations.

Thank-you your advice is appreciated.

Hi @SteveY,

If he is being stood down and not working any hours, then the amount of Super guarantee (SG) payable is nil. We have provided a response on this previously, it is the same link you have included in your post.

Link-

SG information for an employer, including stood down employees.

All the best.
