Re: Jobkeeper- casual employee worked for three years till Dec 2019

An emolyee worked for almost three years as a Barista in our cafe till Dec 2019. As he was doing university study and his availabilty were not maching with our requrements he stopped working with us. He worked with another employer from Jan to March 2020 on casual basis. Now he is availble to work with us few days a week. He is still on our book as his last payroll processed in first week of Jan 2020.

 

Will ATO consider him eligible for jobkeeper benefit if we rehire him? 

As an employer I am happy to rehire him as we couldn't find other Barista to replace him. I am also happy to back pay him for the first fortnight. 

 

Please let me know if it is possible.

Please  see https://www.ato.gov.au/general/jobkeeper-payment/employers/your-eligible-employees/

You cannot claim for any employees who either:

  • were first employed by you after 1 March 2020
  • left your employment before 1 March 2020
  • have been, or have agreed to be, nominated by another employer.

Casual employees are only eligible if they were employed by you on a regular and systematic basis for at least 12 months at 1 March 2020, you will need to check the fair work website in regards to the regular and systematic basis - https://www.fwc.gov.au/unfair-dismissals-benchbook/what-dismissal/periods-service-casual-employee#fi...
