If I have a casual staff member been with us over 12 months and has 6 weeks maternity leave in this time , is she eligible ? She was back at work after the 6 weeks and seems unfair if she missed out

The employee would still be eligible whether the maternity leave was paid or unpaid, and so long as they have: 

  • been working for you (their employer) on a regular and systematic basis for at least 12 months, or
  • a reasonable expectation of continuing work with you (the employer) on a regular and systematic basis, had it not been for the birth (or adoption) of the child
