The requirements are for 80 hours per month, but the months to which they are measured at lands on the last 2 weeks of the school term? This means that if you were working 24 hours per week for a whole term or regularly and it is measured only in the months where you only have 2 weeks of classes and the other 2 weeks, unpaid term break, then you fall short of the 80 hours for Tier 1?

 

Is it possible for a school not to use Alternate Reference and choose only the month of March and June?

Can using the average hours for a whole school term be used if your casual hours fluctuate so much but it still averages the 80 hours per month requirement?

With the only other method to use then the standard 80-hour threshold for employees is the alternative reference period, which is the 28-day period:

  • ending at the end of the most recent pay cycle for an employee, before 1 March 2020 or 1 July 2020
  • in which the employee’s total number of hours of work, paid leave and paid absence on public holidays was representative of a typical 28-day period.

In your case your employer would use the full 28-day payment cycle before the school holidays either March or June, as the alternative reference period. This would represent a typical 28-day period for you.

How far does the 80 hours a month requirement must be consistent?

 

For example:

January - 24hour

Feb - 16 hrs

March - 76hours

April - 94 hours

May - 94 hours

June - 75 hours

 

Would this situation meet the 80 hours per month requirement for Tier 1 and can you please explain why or why not?

The alternative reference period for less than 80 hours and not representative looks at the earlier 28-day periods which were representative.

 

For a school teacher, this would usually mean that the months where school holidays occurred would not be representative, while other months (provided no extenuating circumstances occurred) would be representative.

 

Therefore, for a typical teacher, if February was less than 80 hours and not representative, the closest period that should be representative would be November.

 

However, keep in mind it is self-assessed by you and your employer, so you will need to determine what this means for your circumstance.

With teachers it is a little different.

Expanding on the example, how would representative be selected if the hours fluctuate per term throughout the year.

May - 14 hours

June - 15 hours

July - 18 hours

 

Aug - 92 hours

Sep - 88 hours

Oct - 90 hours

 

Nov - 17 hours

Dec - 20 hours

Jan - 15 hours

 

Feb - 86 hours

March - 88 hours

Apr - 84 hours
