Hi, 

 

My ex-employer is refusing to provide me with payslips or a group certificate.  I worked for them for 2.5 years, they never paid a single payment of super, owe me round $25,000 all up including super and bonuses and I cannot check if my termination pay was even correct as they won't provide me with any payslips or a group cert.  Does anyone know what I can do about this?

If you have a MyGov account and linked to the ATO the employer may have provided the payment summary information to the ATO so this would prefill for you, This page is very helpful https://www.ato.gov.au/individuals/working/in-detail/payg-withholding/lost-or-missing-payg-withholdi...

If you are unable to obtain the payment summary, you will need to estimate your income and withholding details for the relevant employer. One way of doing this is reviewing payslips (if you have any at all), bank statements or a roster.

If you are unable to obtain accurate information from these sources, you will need to estimate your income and withholding details for the relevant employer.

For assistance with estimating your income refer to our gross pay estimator. This will give you an estimate of your gross pay based on your net pay for a particular pay period, either weekly, fortnightly or monthly.

In order to prepare an accurate tax return and support the claims you make, you need to keep thorough records.

You need to be able to show how you arrived at the income and tax withheld figures. In some cases you may be required to provide written evidence of how you arrived at the figures if we ask you to.

You could also contact us and ask the service operator if we have the payment summary information.

The number to call is 13 28 61, Have your TFN with you when you call, we will also ask you privacy questions to verify your identity before we access your account.

 

In relation to the superannuation you canlodge an enquiry,  report your employer using our online tool. Please see https://www.ato.gov.au/individuals/super/in-detail/growing/unpaid-super/ , the number to call us on is 13 10 20

 

I have also had a look on the Fair work website for you to see if there is information that would help, https://www.fairwork.gov.au/ending-employment/notice-and-final-pay
