Going to STP does this now mean employers no longer have to submit Tax File Number declarations via Aus key?

The ATO is implementing a government initiative which provides new employees a means to complete the following new employment forms online:

  • Tax file number declaration (NAT 3092)
  • Withholding declaration - upward variation (NAT 3093)
  • Medicare levy variation declaration (NAT 0929)
  • Superannuation standard choice (NAT 13080) 

If an employee uses the ATO Online new employment service to complete their TFN declaration, then there will be no requirement for the employer to send the TFN declaration to the ATO.

There is a concept in STP, that software will capture all the TFN dec information and therefore be able to submit the TFN dec as part of the normal STP reporting.

This would meet the obligation of employers to "submit" the TFN Dec.

Dont hold your breath.

If we think about everything an employer has to do and obtain and later on possibly prove about employment relationships, we dont see the concept of the TFN dec dissappearing for some time.

Unfortunately there is a school of thought that becuase its just data and can be sent that the world got simpler and the tfn dec will be removed - the thought is rubbish. 

 

Your comment was "via auskey".  The data will need to be sent somehow.  Auskey is destined for removal over the  next couple of years so any auskey facilitated lodgement will need to alter to the new authorisation mechanisms
