If an individual does not have an excess Transfer Balance, but does exceed the Defined Benefit Income Cap, do they retain the 10% Australian super income stream tax offset on amounts in excess of the DBIC?

The better way to approach this especially seeing that you wish to clarify this for your spouse is to apply for ATO  administratively binding advice  which will provide you with taylored advice and also give you the opporunity to discuss the issue with the ATO officer that is going to provide the written response.
