Hi, I'm in a band with a few friends which is definitely not a money making band, but we recently used an online service to put some of our songs up on Spotify. I'm just curious about whether I would need to claim any potential royalties income that would come from this? If we did make anything it would be paid in US dollars into a Paypal account.

Hi @bookiegnu

Thanks for getting back to me, I would highly recommend that you complete the  Hobby or Business tool, the reason why I suggest this is because I am thinking that it may show characteristics of a business - Please see, https://www.ato.gov.au/business/starting-your-own-business/before-you-get-started/are-you-in-busines..., You have done the right thing by completing the statement by supplier previously however the bands circumstances sound like they maybe changing.

Even though you may regard it as a hobby it maybe that because the band is starting to making money from that online presence, This page is also helpful - https://www.ato.gov.au/business/starting-your-own-business/in-detail/online-selling---hobby-or-busin...

I would recommend that you give us a call and speak with the business area  on 13 2866, when you get through to this area they may need to transfer you through to an area that is able provide more specific answers to your question/s

Regards, Tracey

Hi @bookiegnu

Great question, however, I would need to know if you have an  (Australian buisness number) as an individual or does the band work as a partnership with its own ABN, or no ABN? I will be able to give you better response/advice once I know this.

Thanks for replying, Tracey.

I personally have an ABN, but that was in relation to the possibility of doing freelance graphic design work, which never eventuated.

The band does not have an ABN, and from memory on the very few occasions we did have paid gigs (this would have been 10-15 years ago), we provided a hobbyist form, or statement by a supplier for not providing an ABN.
