Re: Child support you paid for children oversea

Hi,

My client has children living oversea with their mother (his ex-partner).

He provides money monthly to support them and my client and his children hold Australia Permanent Visas.

Is it ok to add them as dependent and add this money sent overseas "Child support you paid"?

Thanks,

Hi @mosampaio

@VolcanoMan has provided you with some helpful guidance. Depending on your client's circumstances, it may be worth getting us to take a closer look at it.

Only dependent children who are Australian residents (and meet the other requirements outlined on our website) should be included at IT8 Number of dependent children on the tax return. As you have mentioned that the children live overseas, it needs to be determined whether they are Australian residents for tax purposes, not immigration purposes.

For more information about how to work out your tax residency, have a look at our website.

If your client paid amounts or provided benefits to another person other than their partner for the maintenance of their children, you can add up all the amounts they paid as well as the benefits they provided for their children's maintenance during 2019–20 and declare it at IT7 Child support you paid.
