Obtaining a tax ruling to see if my university masters degree is tax deductible

Hi everyone,

I am a quantity surveyor working in NSW. I have started a distance-learning part-time masters degree in Building Services Engineering from a UK university. This is quite a large investment on my part, and I would like to be certain that ATO would interpret this as tax deductible before I make a claim. My reasoning for thinking I can potentially claim course fees is that, as I work in construction, further knowledge of building services will enhance my earning ability whilst staying within the quantity surveying profession.

Is this the sort of thing that private tax rulings are available for? What sort of evidence would I need to provide to persuade ATO of my reasoning?

Thank you

A private ruling is the only way to get certainty of tax advice. I would apply for one in your situation too. Read about how to get one here: https://www.ato.gov.au/General/ato-advice-and-guidance/ato-advice-products-(rulings)/private-rulings.

You need to provide all the facts around your current role and how it relates to the study. It is much more about facts than persuasion. Read what makes education deductible and be sure to include all relevant information: https://www.ato.gov.au/individuals/income-and-deductions/deductions-you-can-claim/self-education-exp...

Generally, if you're eligible to claim a tax deduction for work related expenses, you can claim the expense in your tax return for the financial year in which the expense was incurred.

Thank you, I have sent an application in for a tax ruling. How long do these usually take?
