Hi there, my question is about UBER under partnership.

We have a family partnership (wife-husband) registered for GST and ABN. I've started UBER. Do I have to apply for GST and ABN as a Sole Trader or can I do my uber under my family partenrship? Everywhere I just find " typically operating under a Sole Trader business structure", but I can't find "must" operate as Sole Trader. Thanks

Hi @J2019,

Thanks for your question!

The ATO cannot determine what kind of business structure you should operate as. Generally speaking, Uber drivers will be sole traders because this is the most convenient way for them to operate their business.

If you wish to operate your Uber business under a different business structure, then that's your choice. Operating a business partnership will have different tax implications than operating a business as a sole trader, but we don't have any restrictions around what kind of business activity each different business structure is allowed to perform.

Hope this helps,

Rachael B.
