      <description>&lt;P&gt;I have been able to successfully use the myGovID app on a Samsung A50 (v 9) and on an iPhone XR, but I cannot get the app to work on a Samsung S9 (v 10). When it comes to&amp;nbsp; opening the app on the phone to enter the "linking code", the app on the phone immediately shuts down,&amp;nbsp;&lt;SPAN&gt;without even giving an error message.&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;I have uninstalled and reinstalled the myGovID app 5 times on the S9 phone. It still does not work on the S9.&lt;/P&gt;&lt;P&gt;Can anyone offer any advice please?&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>Just wondering with my ABN getting cancelled is there a way to keep it if my work has dried up for over 12 months? My dilemma is I've just picked up work recently and seen my ABN is no longer active, so do i just do a cash in hand job and pay no tax because my ABN has been cancelled or do I have to apply before being able to do this job and accepting work? I do investigative work being pro bono at first, but now picked up a trace job that I've recently quoted with a price. Its a free country i dont understand why ABNs get cancelled not everyone can get steady work for their own business while working full-time and everyone should be entitled to the one ABN number they apply for. Should only be cancelled if someone is deceased or they choose to cancel it.&lt;BR /&gt;Now if I reapply for it will I be rejected if i have a select few jobs? because I don't mind doing the job cash in hand for the month and losing my business phone account and email that I use to gain potential clients with a inactive abn. Fair enough I haven't been able to claim tax on the ABN for a while but wages have been stagnant for some time while people do their own investigation work on their social medias leaving me with limited work to begin with.&lt;BR /&gt;What I'm trying to say is do I renew my ABN and do this one job for a month or do I just do the job without the ABN since I'm not allowed to have it if it gets cancelled all the time. Government wonders why they lose out on revenue, because they use old systems that force people onto cash in hand work. And no I do not condone cash in hand work I'm just sick and tired of trying to justify my ABN everytime its up for review, all while the work is limited and for when i do pro bono work to gain experience.       <description>&lt;P&gt;The new sign-on requirements for the new Mygov.id is proving a nightmare for tax practitioners. We are a firm of tax accountants and need to log into the tax portal many times per day. However due to the portal timing us out we need to constantly re-log in. The new signing on verification requirements whereby we must verify a code on a mobile phone is already proving incredibly cumbersome and extremely time consuming.&amp;nbsp; The previous system was slow but seemed to work ok. The original tax agents portal was quick and efficient. Surely there has to be a better way as it seems that each iteration of the protal is becomming a step backward in office efficiency. The requirement to log in via mobile phone is an enormous step backwards for busy practioners. &amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;Hoping someone can help, I just cant find the answers I need. So I have been working in a business for a while now but as I look into it, things are looking funny and I'm not sure it is legit.&lt;/P&gt;&lt;P&gt;The shop has a sign out the front (and stationary etc) that says 'Sample Shop' (just a dummy name for this purpose).&lt;/P&gt;&lt;P&gt;If I look up Sample Shop, it is associated to an ABN that was cancelled in 2016 by a previous owner.&lt;/P&gt;&lt;P&gt;I have some paperwork from my work there from August 2017 and it still displays the cancelled ABN .&lt;/P&gt;&lt;P&gt;One lady says she is the owner, however when I look it up, although she does infact have a Business Name registered in her name, it is not Sample Shop it is 'My Trading' with a different ABN to that which was previoulsy associated with Sample Shop.&lt;/P&gt;&lt;P&gt;So Sample Shop is running and is a registered business name however seems to have no ABN associated with it.&lt;/P&gt;&lt;P&gt;The current owner says "I am the owner of Sample Shop, trading as My trading" - but she is not, she is trading as Sample Shop.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;In addition, neither the cancelled ABN assicated with Sample Shop or the ABN associaed with My trading is GST registered.&lt;/P&gt;&lt;P&gt;Does this sound dodgy?&lt;/P&gt;&lt;P&gt;Thanks!&lt;/P&gt;</description>

      <description>&lt;P&gt;I have been contacted by the ATO to submit a NAT 2943 form to change details of my community organisation.&amp;nbsp; I promised to have it done within the next day,&amp;nbsp; but the only way I can get a copy of the form is through the online request and the form can only be sent to me by post.&amp;nbsp; I noted that another person had a similar problem obtaining the form and the form took 3 weeks to arrive.&lt;/P&gt;&lt;P&gt;I am not the registered person for this community organisation as I had only taken over the position earlier this year.&amp;nbsp; So I cannot do the changes on line, and the registered person has now retired and is currently travelling around the world.&lt;/P&gt;&lt;P&gt;Do I just wait for the form to arrive by post?&lt;/P&gt;&lt;P&gt;Thanking you&lt;/P&gt;&lt;P&gt;Ami&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;Hello All,&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I am newly registered tax agent got my registration on 24the July 2019, previously I used to hold BAS agent registration for past 4 years.&lt;/P&gt;&lt;P&gt;After receiving my registration I was informed that my tax agent portal login should be working within 21 days of receiving the registration. Though I received acknowledgment from ATO about my registarion on 8th August 2019 I was unable to log into ATO portal. Calling the registration team ( 137286&amp;nbsp; fast code 3, 3) my queries were ignored saying I can raise the request only after 21 days hence after 15th August. Since 15th August I am calling ATO everyday with request to check why my ATO portal ( both TAX and BAS) is not working ( getting error A918.26 when I put my password in login screen) but I have received no help. This is causing my work to be very behind unable to lodge client BAS, super obligations.       <description>I'm trying to get my AUSkey installed. I've got as far as getting my Activation code. When I select the "Install AUSkey" Tab I am given the message "There is just one more step before you can install your AUSkey. You need to download and install the AUSkey browser extension software on your computer. When completed, please go back to your email and attempt to install your AUSkey again." So I did just what I was told, downloaded the AUSkeyInstaller.exe and installed the extension for my Firefox Browser. Then alas, I was in a loop getting the same message with no AUSkey installation. I've rebooted, uninstalled, reinstalled to no avail. Please help me I'm at a total loss.</description>

      <description>&lt;P&gt;Hello,&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My question relates to the situation regarding GST payable on imports as from 1/7/18. I believe that GST is payable on the cost of an item purchased and not on the freight/postage cost of getting getting it into Australia? This is in reverse to postage stamps currently available both with GST included for home consumption but without GST for export.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If this is correct, then eBay is charging GST on the cost of goods and on freight/postage costs. The situation is made slightly more complex by the fact that the example under scrutiny was bought from a Malaysian identity using the American site (in US$), so eBay's site in the Philippines which handles Australian enquires has said it's nothing to do with them, but suggested I talk to the Americans.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;This situation will bring in more tax (that's tax plus wrongly collected "tax") that the law allows them to collect.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Please can you advise to both the ATO's position and the course it will take in answer to this situation. I had a discount voucher from eBay, so was given a 5% discount ($3.13) taking the purchase price down to $59.36. The voucher was provided by eBay.&lt;/P&gt;&lt;P&gt;But the GST was calculated on the original purchase price, so I was charged $6.25 GST. This should have been $5.94.&lt;/P&gt;&lt;P&gt;This become impossible to account for. Is the voucher income from eBay to me? That's the only way I can get the GST to add up.       <description>&lt;P&gt;I have a few questions about&amp;nbsp;GST liability in a&amp;nbsp;situation where a partnership is partitioning land. Presume four partners have a 25% interest each in a piece of land.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;There seem to be two conflicting theories, reading&amp;nbsp;GSTR 2003/13 and GSTR 2009/2 together.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;The co-owner theory suggests that GST will be based on the market value of the interest received, apart from the interest the co-owner/partner already possesses. This would be 75% of the other three partners' interest in their quarter of the land (see pgph 49 and 93, 97-98 in 2009/2)&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;A second theory would result in GST being on 100% of the interest acquired, regardless of the partner's 25% legal interest, because&amp;nbsp;the partnership is deemed to be the supplier and a partner does not have a right to any particular property of the partnership. This means a partner's 25% legal interest is illusory for GST purposes&amp;nbsp;(see pgph 145-149 and 153-154)&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;1. What is the value of the consideration? 75% of the transfer, or 100%? Consideration is determined based on what is received, not what is given. But the partnership receives nothing. Unless the consideration is the resulting reduction in the value of the partner's interest in the partnership.&lt;/P&gt;
&lt;P&gt;2. In the context of new residential property, does the partner give notice (where the recipient is liable for GST)?&lt;/P&gt;</description>

      <description>&lt;P&gt;Withholding tax on potential residential land.&amp;nbsp; My clients, a young couple are onselling a piece of vacant residential land purchased off the plan.&amp;nbsp; They are not registered for GST.&amp;nbsp;&amp;nbsp;Pre 1st July this sale would have not normally attracted GST,.&amp;nbsp; If the purchaser withheld 1/11th of the purchase price, my clients have no way of claiming it back as they do not submit BAS statements.&amp;nbsp; I cannot find anywhere on the ATO website that this would be an exce exemption to the rule.&amp;nbsp; ATO said that their vacant residential land they are selling is not a taxable supply and therefore the withholding provisions do not apply but I cant get&amp;nbsp;anything in writing nor find any evidence to support his advice.&amp;nbsp; Im not having much luck with their accountant either.&amp;nbsp; Can anyone please clarify this for me?&amp;nbsp;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thank you.&lt;/P&gt;</description>

The housing market has been fairly stagnant since he purchased the property, and we have been examining our options to best realise the value of the asset. Due to the size of the block, we have the option to demolish the existing dwelling, and subdivide into 3 blocks, which we would then sell as vacant land. Could you please advise as to the taxation implications of this sale?       <description>&lt;P&gt;&lt;STRONG&gt;Question 1: is the penalty in section 16-30 of Schedule 1 to the Tax Administration Act in addition to, or in place of, the payment required under section 14-250 (1) (in sub-division 14E) of that schedule?&lt;/STRONG&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Under section 14-250 (1) "You must pay to the Commissioner an amount if…"&lt;/P&gt;&lt;P&gt;There is no explanation&amp;nbsp; in section 14-250 of what happens if you don't.&lt;/P&gt;&lt;P&gt;Section 16-30 (1) provides that an entity failing to pay an amount under Division 14 "is liable to pay to the Commissioner a penalty equal to that amount".&lt;/P&gt;&lt;P&gt;Section 16-30(2) provide some exemptions where the supply was of new residential premises but, interestingly, not if the supply was potential residential land.&lt;/P&gt;&lt;P&gt;On the face of it, there is no relief whatever for failing to make the payment under section 14-250.&amp;nbsp; Seemingly the only relief is limited relief against payment of a penalty equal to, and in addition to, the required payment.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;STRONG&gt;Question 2 – If in the contract the vendor and purchaser agree that the margin scheme will apply, but under section 75-5 (3) of the GST Act the supply is ineligible for the margin scheme does 14-250 (6) (a) actually apply?&lt;/STRONG&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;There are plenty of situations where a supply is ineligible for the margin scheme– for example where the vendor paid GST on the purchase of the property without applying the margin scheme – and the possibility of a vendor not realising it's ineligibility is not remote. In our practice we see any number of situations where conveyancers and solicitors do not understand the detail of GST.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The section does not say "if the supplier and the recipient agree the margin scheme applies "or something similar. It simply says "if the margin scheme applies". But the margin scheme can't apply if the supply is ineligible, despite what the contract says.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

These invoices were paid back in 2016. Now the supplier has issued us a credit note for the paid non-gst invoices and a new tax invoice&amp;nbsp;including the GST.&amp;nbsp;Effectively we won't have any&amp;nbsp;cash flow&amp;nbsp;impact as the additional amount we have to pay to the supplier can be claimed from the ATO. Just want to confirm the following:&lt;/P&gt;&lt;P&gt;- Do we require an ATO ruling for this?&lt;/P&gt;&lt;P&gt;-&amp;nbsp;Can we&amp;nbsp;record this transaction in the current period and claim the GST?&lt;/P&gt;&lt;P&gt;- Any special disclosures required in BAS?&lt;/P&gt;&lt;P&gt;- Do we require any proof/documentation from the supplier?&lt;/P&gt;&lt;P&gt;Thanks&lt;/P&gt;</description>

I would like to set up voluntary PAYG payments in myGov to help me plan for my tax. (Note, Im not GST registered).&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Last financial year I earned more than $4000 in income as a sole trader. However, after deductions my tax payable was less than $1000.&amp;nbsp;So, from what I've read on the ATO website, the automatic PAYG payments have not been triggered for my tax account.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I dont know how much i'll earn this year, but i'd like to just pay my tax as soon as I recieve the income as opposed to putting it aside for EOFY. How do I do this? The ATO website says go to ATO account in MyGov. But I cant see an option to set up voluntary PAYG.&lt;BR /&gt;&lt;BR /&gt;Thanks&lt;/P&gt;</description>

I wrote notes on the first couple of PAYG notices and explained the ABN was inactive. They stopped coming so I presumed the matter was sorted. I did a search on the ABN and it had been cancelled - today it has been reactivated?? Now they are demanding all the backdated PAYG even though my returns have all my employer details pre filled. I also tried to search many forums and google but didn't find an answer. Also my accountant couldn't answer me clearly. I will be grateful for any advice&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I'm a non-resident and non-citizen living outside of Australia (I used to live there but not anymore). I still do some work for some Australian companies so I still use my ABN for the invocies. I would use my international/national business number for invoices but the problem is some Australian businesses don't accept international business numbers which is why I have to use an ABN. I'm not really sure how it works whether&amp;nbsp;I'm entitled to still use my&amp;nbsp;ABN or not. I don't have a problem filing the tax return and paying the taxes - just not sure I'm suppose to be doing this since I don't live and work in the country and not going to result in some problem? I also contract my services (event staff/labouring, not transport related) to major events using the same ABN. My question is do I have to charge GST on the non UBER related invoices then claim it back at a later point?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Am I better off having two ABN's. One with GST registration for UBER and one without for other income? Is that even allowed?&lt;/P&gt;</description>

I have changed&amp;nbsp; all the numbers below to remove financial data but it helps me understand if I can see the calculations.&lt;BR /&gt;&lt;BR /&gt;I am a sole trader. I do not have any employees.&lt;BR /&gt;&lt;BR /&gt;My gross income from my business - the amount invoiced under my ABN - is&amp;nbsp;&lt;/SPAN&gt;&lt;SPAN&gt;$30,000.&lt;BR /&gt;&lt;BR /&gt;I have&amp;nbsp;$14,000&lt;/SPAN&gt;&lt;SPAN&gt;&amp;nbsp;in expenses, giving me a net business income of&amp;nbsp;$16,000.&lt;BR /&gt;&lt;/SPAN&gt;&lt;SPAN&gt;&lt;BR /&gt;I have $9,000 in income from casual employment making my taxable income $25,000&lt;BR /&gt;&lt;/SPAN&gt;&lt;BR /&gt;&lt;SPAN&gt;$18,200 of that is tax free, leaving $6,800 that is taxable at 19%.&lt;/SPAN&gt;&lt;BR /&gt;&lt;BR /&gt;&lt;SPAN&gt;19% of $6,800 is $1,292. &lt;/SPAN&gt;&lt;BR /&gt;&lt;BR /&gt;&lt;SPAN&gt;I have offsets of $445 available, which would reduce the amount of tax payable to $837.&lt;/SPAN&gt;&lt;BR /&gt;&lt;SPAN&gt;&lt;BR /&gt;I have paid $1200 per quarter in PAYG instalments making a total of $4800.&lt;BR /&gt;&lt;/SPAN&gt;&lt;SPAN&gt;&lt;BR /&gt;My employer has withheld tax of $2,000.&lt;BR /&gt;&lt;/SPAN&gt;&lt;BR /&gt;&lt;SPAN&gt;My understanding was that PAYG functioned in the same way as tax withheld by an employer, and that any amounts not needed to meet your tax burden were refunded. Is this wrong?&lt;/SPAN&gt;&lt;BR /&gt;&lt;SPAN&gt;&lt;BR /&gt;I am using ETax to lodge my return this year (for the first time - I have always done it myself before). They suggest the refund estimate on my return is $2,000, which is the amount of tax withheld by my employer.&lt;BR /&gt;&lt;BR /&gt;I can also see that the accountant has deducted my PAYG instalment amount from my net business income, giving me a net income from my business of $11,200, but I don't understand why?&lt;BR /&gt;&lt;BR /&gt;It seems as though they are counting the PAYG instalments as a business expense that I have paid to the ATO, which suggests I don't get any of it back. Is that how it works?&lt;BR /&gt;&lt;BR /&gt;My understanding is that I have paid $6,800 in tax already, that my tax obligation is only $837, so I should expect to get $5,963 back... No?&lt;BR /&gt;&lt;BR /&gt;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;I am sorry if this is a dumb question, I am just really confused!       <description>&lt;P&gt;I have a number of subcontractors that are trying to obtain reimbursement by just giving me their expenses and not 'invoicing' me through their employing agency or ABN entity and requesting that I pay directly to their personal bank accounts.&lt;/P&gt;
&lt;P&gt;The question is, in this case are these claims subject to withholding tax in this instance?&amp;nbsp; It is my understanding that they would be as no ABN is being quoted.&amp;nbsp; However, there is the argument that why could they not claim expenses incurred doing the job that the company has subcontracted them for.&lt;/P&gt;

I want to file my Tax returns for the first time.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I am currently out of Australia for some work and will not return before November, so I need to get my ATO linked to Mygov soon.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;When I choose, use questions specific to me, I enter the following details&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;PayG Summary Gross Income in 5 digits without spaces or decimals or comma.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Superannuation account details as below:&lt;/P&gt;&lt;P&gt;The Super Fund ABN without spaces, comma or any other character. Only numbers.&lt;/P&gt;&lt;P&gt;Member account number ??? On my Super Fund statement, I have a member Number and an Account number.&lt;/P&gt;&lt;P&gt;Which one should I enter? Or is it member number and account number both to be entered?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have tried but it fails to identify any records in the ATO.&lt;/P&gt;&lt;P&gt;I can't call ATO as I'm out of Australia.       <description>&lt;P&gt;Hi ATO community&lt;/P&gt;&lt;P&gt;I am so glad to find you!&amp;nbsp; My question is this.&amp;nbsp; I run a charity here that is registered with an ABN and also has ACNC approval.&amp;nbsp; Through an overseas company, that is registered in the USA for tax deductibility, we are running a campaign to sponsor "Shoes That Grow" (they really grow 5 sizes, come in 3 different shoe ranges, and last 5 years) for over 100 pairs of shoes that I will pick up in Uganda when I am there to fit onto their little (and not so little feet) of the fee-free school that we have just opened in rural and remote Uganda.&amp;nbsp;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My question is, and I have rung the ATO when I have not been infront of a computer, and apparently there is a place on their site that I can check to see if the charity in the USA is also a registered charity with DGR.&amp;nbsp; I have tried many times over the last few days to remember what I was told however i cannot seem to do a word appropriate search to find it on their site.&amp;nbsp; (I asked if they could email me out the link but sadly they do not have that capacity, which I find a little strange but have to accept.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;So dear community, would you be so kind to point me to the approprate search.&amp;nbsp;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Kiindest regards and thanks for this service.&lt;/P&gt;&lt;P&gt;TAP&lt;/P&gt;</description>

Prior to that I was receiving Newstart Allowance.&lt;/P&gt;&lt;P&gt;In between all of that I had recieved a few odd payments through my ABN for performance related work. *This included accepting the full payment on behalf of a band and then having to pay other members in the group.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have also received money through my ABN on behalf of a project that was awarded an arts grant. None of this money was for wages and has been successfully acquitted.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I am not sure of how and where to record this infomation, in particular on the H&amp;amp;R on-line forms that I have chosen to use. However, your email doesn't quote the employer name or employer ABN, which would be useful as we complete a large number of payrolls within our firm and locating the employee can be quite time consuming.&lt;/P&gt;

      <description>&lt;P&gt;Hi, I am an Australian resident, and I am doing work for an overseas company (all online) where I invoice them every quarter based on the amount of work I've done.&lt;/P&gt;&lt;P&gt;Do I need to setup an ABN?&lt;/P&gt;&lt;P&gt;If I don't, I understand they would be required to withhold 49% and give it to the ATO, however in reality this wouldn't happen because they do not know anything about Australian tax, they simply email me the work, I email them the invoices, and they pay into my (Australia) bank account.       <title>Regarding my previous 4-5 years tax losses</title>

      <description>&lt;P&gt;Hi,&lt;/P&gt;&lt;P&gt;I have been trading CFDs/Binary Options( with both Australian brokers and ofshore brokers) ON and OFF since several years( part-time trader, got a day job) but never made money on an annual basis, so never bothered to claim any losses. I recently started making some money from July-2018 and thus started thinking about my tax liabilities in a case if I am profitable for the year (2018-2019). So my question is:&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;1) I have accrued losses since July 2014- June 2018 (each year), so can I claim total losses as offset in my next year 2018-2019 returns. Or do i need to claim losses against my assesable income in this year returns ie..2017-2018.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;2) Do I even have to put these losses( or future profits ) in my returns as sometimes I trade heavily, while at times I am trading once in a month. Intention obviously is to make secondary money from trading but is not happening. A FAMILY FRIEND&amp;nbsp;RUNS A CAFE AND HAS REQUESTED AN OPINION ON THE FOLLOWING SCENARIO.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;MY FRIEND WANTS TO ENGAGE A CHEF FOR NIGHTIME MEALS ON THE FOLLOWING BASIS.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;THE CHEF WOULD EMPLOY HIS OWN STAFF IN THE EVENINGS TO PREPARE MEALS AND WAIT ON TABLES.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;THE CHEF IS A SOLE TRADER, HAS AN ABN NUMBER AND IS REGISTERED FOR GST.&amp;nbsp; I AM TOLD THAT AS THE CHEF&amp;nbsp;IS TO EMPLOY HIS OWN STAFF AT THE CAFE , HE COULD BE A LEGITIMATE CONTRACTOR PROVIDED IT IS DONE THROUGH HIS COMPANY OR PARNERSHIP BUT NOT AS A SOLE TRADER.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;THE NEXT PART OF THE QUESTION CONCERNS GST.&amp;nbsp; DUE TO LIQUOR LICENCING RULES, ONLY ONE BUSINESS CAN OPERATE AT THE SITE AND ALL SALES NEED TO GO THROUGH MY FRIENDS BANK ACCOUNT.&lt;/P&gt;&lt;P&gt;THIS MEANS THAT GST FOR SALES IS THE RESPONSIBILITY OF MY FRIEND .&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;THE EVENING SALES BELONG TO THE CHEF AND HE WOULD BE REIMBURSED EVERY DAY FROM THE BANK ACCOUNT LESS GST COLLECTED.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;THE NET PAYMENT DAILY TO THE CHEF WOULD ACTUALLY BE AN EXPENSE (CONTRACTOR ) IN THE BOOKS OF MY FRIEND.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;UNDER WHAT CIRCUMSTANCES (IF ANY) CAN&amp;nbsp; MY FRIEND CLAIM THE GST BACK&amp;nbsp;FROM THE TAXABLE SUPPLY PAID TO THE CONTRACTOR.&amp;nbsp; I ASSUME THE CONTRACTOR WOULD NEED TO ISSUE A TAX INVOICE FOR THESE AMOUNTS (OR COULD A RECIPIENT GENERATED INVOICE BE PREPARED.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;IT IS MESSY TO SAY THE LEAST.&amp;nbsp; YOUR ADVICE ON THIS OR FURTHER UESTIONS TO ME WOULD BE GREATLY APPRECIATED.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;THANK YOU&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>
