      <description>&lt;P&gt;Hi ATO community,&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I woud like to enquire about whather it is viable/ reasonable to withdraw my superannuation once I've left Australia even though I intend on returning to Australia as a student. I am currently holding a student visa, which will be expiring this coming March 2020 after completing my undergradate studies. I have decided to take some time off before going into posgraduate studies in 2021. As I will not be in Australia for roughly a year and will be on an expired visa once I have departed, I am wondering if withrdrawing my superannuation would affect future visa applications, including those that lead to permanent residency. I am planning on applying for PR once I have completed my posgradtue studies, yet I am unsure as to whether I would be allowed to claim my super again in the future?       <description>&lt;P&gt;Hi there,&amp;nbsp;&lt;/P&gt;&lt;P&gt;I've recently filled my DASP claim and received the money from my super fund.&amp;nbsp;&lt;/P&gt;&lt;P&gt;I came to Australia in 2015 on a Working Holiday Maker visa (417) and after 5 months I was sponsored on Skilled Work Visa (457) for 3 years.&lt;/P&gt;&lt;P&gt;In the lead up to filling the claim I've spoken to one of the ATO employees who told me that even though I came out as a Working Holiday Maker I should not be taxed 65% on the period I was on a 457.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Can you please confirm this is correct so I can file a complaint with my super fund.&amp;nbsp;&lt;/P&gt;&lt;P&gt;Kind regards,&lt;/P&gt;&lt;P&gt;Veerle Verlooij&amp;nbsp;&lt;/P&gt;</description>

I eventually switched to a 482 Visa in 2018.&lt;BR /&gt;&amp;nbsp;&lt;BR /&gt;From what I understand, If I choose to leave Australia in the future, all of the super I have earned to date will be taxed at the Working Holiday rate of 65%, which is naturally quite alarming.&lt;BR /&gt;&amp;nbsp;&lt;BR /&gt;Can I avoid this by simply opening a second fund and transferring what I had earned on the 482 Visa?       <description>&lt;P&gt;Hi there,&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have left Australia and recently my visas have expired, I'm now overseas and have had some difficulties with processing my DASP to get my super funds, I've tried calling from overseas but with the phone expenses I can't afford to stay on hold for too long unfortunately.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Firstly, many of my friends processed their DASP through the online application, when I try I am presented with the following error message, which nobody else has seen:&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;Not eligible - not known&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;Based on information supplied to us by the Australian Department of Home Affairs we are unable to establish that you are the holder of a temporary resident's visa under the Migration Act 1958. If you are the holder of a temporary resident's visa under the Migration Act 1958 check the details you entered are correct, then try again. Alternatively, you may send a&amp;nbsp;&lt;A href="http://www.ato.gov.au/superfunds/content.aspx?doc=/content/23637.htm" target="_blank" rel="noopener"&gt;paper application&lt;/A&gt;.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;To clarify, I was on a 2 year WHV and following that a student visa. All of which have now finished, I have confirmed with my super that my account with them is still open and has not been transferred to the ATO.&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;Because of this error I figured I might have to do the paper application which seems to have more information required. The second question I had was regarding getting a certificate from the Department of Immigration. It states if I am due to receive over $5000 this will be required, if not I can just show evidence I've left the country. In my situation, my current super savings total over $5000, however once the 65% tax is applied it will definitely be under that value. Does that mean I can just provide my own evidence I've exited the country, therefore avoiding further fees for a certificate and a 21 day wait time for this to be sent to me. What rate will I get taxed at? I am considering the option of retiring in Singapore and am wondering if I became a foreign tax resident, would the taxed and taxable taxed component of the pension remain untaxed (as i will have reached preservation age) as they would if I was an Australian tax resident, and would only the untaxed portion of the pension be subject to the foreign resident tax rate of 32.5c for each $1 ?&lt;/P&gt;</description>

      <description>Hi all!&lt;BR /&gt;I was in Australia on a Working Holiday VISA for 1 year (October 2018-October 2019). After my WHV expired, I went to Bali for 1 week and then came back into Australia on my Tourist Visa (601/ETA). I left the country for good on November 17th 2019. I’m now back in England and want to claim my super back... but my ETA lasts for 1 year and doesn’t expire until October 2020. I have phones immigration to ask if they will cancel the visa so I can claim my super - they said they can’t. I then phoned the ATO who were absolutely useless and said there was nothing that could be done. I’m at a loss now about what to do. I imagine this MUST be the case for a few people who return after their WHV has expired...&lt;BR /&gt;&lt;BR /&gt;Please help!!</description>

Then I got permanent residency in 2013 but left Australia in 2013 and have not returned since. The permanent residency has expired and I still have quite a bit of money in an ANZ Smart Choice super account. I have the membership number and spoke to a person in ANZ last year who gave me the balance but no details on how to withdraw it. I've tried the onlie ATO DASP process but do not have the product details of the account this has identified i.e. SPIN, start date, etc. Is there a paper based form i can use or a specific dept within the ATO that I can speak to or do I have to liaise with ANZ direct?       <description>&lt;P&gt;Hi, &amp;nbsp;&lt;/P&gt;&lt;P&gt;I found what I understand may be a discrepancy between the information provided on the ATO web site and the SIS regulation regarding proof of identification for DASP. I would like to hear someone’s opinion, please.&lt;/P&gt;&lt;P&gt;In reference to DASP payments the ATO web site states that a benefit payable under SISR Schedule 1 item 103A by the super provider must meet the requirements set out in &lt;U&gt;SISR regulation 6.20A&lt;/U&gt;.&amp;nbsp; It also states that if the withdrawal benefit is less than $5,000 you (I assume, a superannuation fund) don't need to undertake the client identification procedures required by the&amp;nbsp;&lt;EM&gt;Anti-Money Laundering and Counter-**bleep** Financing Act 2006&lt;/EM&gt;&lt;/P&gt;&lt;P&gt;However, SIS regulation 6.20A States that If the member's withdrawal benefit in the fund is less than $5&amp;nbsp;000, the trustee of the fund &lt;U&gt;must&lt;/U&gt; receive:&lt;/P&gt;&lt;P&gt;&amp;nbsp;(b)&amp;nbsp; a copy of the member's passport showing that the member has left Australia.&lt;/P&gt;&lt;P&gt;Also AUSTRAC, states that as a reporting entity we must apply customer identification procedures to all customers, which contradicts the above statement from the ATO.&lt;/P&gt;&lt;P&gt;I’m assuming that we need to error on a side of caution and request client’s ID for all DASP payment.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

I have departed Australia and moved to New Zealand.&lt;BR /&gt;&lt;BR /&gt;I had planned to pass through Australia on my way back to the UK where I am from, and so applied for a visitor visa (651) which was granted.&lt;BR /&gt;&lt;BR /&gt;In applying for my DASP, I have been notified that I cannot submit my application as I have a current visa (the visitor 651).&lt;BR /&gt;&lt;BR /&gt;I no longer wish to re-enter Australia on my tourist visa if it means I cannot access my super. I didn't realise this was the case.&lt;BR /&gt;&lt;BR /&gt;I've tried to cancel my visitor visa but this is not an option on the website. It says I cannot cancel a visa once it has been granted.&lt;BR /&gt;&lt;BR /&gt;Please can someone give me some advice about how I can cancel the 651 visa?&lt;BR /&gt;&lt;BR /&gt;Thank you!</description>

      <description>&lt;P&gt;Hi&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I've been leaving Australia for good since February 2019&lt;/P&gt;&lt;P&gt;I've also cancelled my 457 visa and successfully submit my DASP with ATO online on October 2019&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;A href="https://applicant.tr.super.ato.gov.au/applicants/default.aspx?pid=1" target="_blank"&gt;( https://applicant.tr.super.ato.gov.au/applicants/default.aspx?pid=1 ) &lt;/A&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;But I still heard nothing about my DASP&lt;BR /&gt;I've ask my Superfund about this, and they said that they still not received my DASP application from ATO so they can't process my DASP.&lt;/P&gt;&lt;P&gt;but when I check with ATO via email and got confirmed that from ATO system,&lt;/P&gt;&lt;P&gt;my DASP application is sent and received by my Superfund on October 2019&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;so my questions are :&lt;/P&gt;&lt;P&gt;1. In my situation, is possible for ATO to resent my DASP application to my Superfund ?&lt;/P&gt;&lt;P&gt;2. Is it possible for me to create a case / email including both ATO and my Superfund support, so I can work this out together ?&lt;/P&gt;&lt;P&gt;3. It is ovious that the supperannuation amount paid durling 2013 to 2015 is before new&amp;nbsp;tax rate is issued. Moreover, It&amp;nbsp;was charged 65% to the supperannuation I have received while I worked under the Sutudent visa from 2015 to 2019. I thought is is not fair.&lt;/P&gt;&lt;P&gt;I asked my supperannuation fund then they told me the tax rate is not our decision so contact ATO. ATO does not give me any answer for&amp;nbsp;my question.&lt;/P&gt;&lt;P&gt;Could you please tell me if my super should charged 65% of tax or not?&lt;/P&gt;&lt;P&gt;I have held only one supperannuation account through 2013 to 20&lt;/P&gt;</description>

Im a NZ citizen but also hold South African citizenship as i was born there.&lt;/P&gt;&lt;P&gt;So ive entered and worked in Perth under the NZ citizenship.&amp;nbsp;&lt;/P&gt;&lt;P&gt;Im in the process of moving back to South African next year for family reasons.&amp;nbsp;&lt;/P&gt;&lt;P&gt;I would like to claim my super, ive contacted my fund and they have advised i speak to the ATO.&lt;/P&gt;&lt;P&gt;Ive begun filling in the DASP online form, but cant proceed, it says the NZ passport isnt eligeble and when i try the RSA passport&lt;/P&gt;&lt;P&gt;it says ive never held a visa, this is because ive entered under the NZ passport. So what to do? im not going back to NZ but RSA. Would i need to go to ATO offices and speak to someone in person? Thanks for the help&lt;/P&gt;</description>

My sponsorship visa application process was underway before I moved to Australia but unfortunately didn’t come through in time therefore I had to apply for a WHV so that O could enter the country and start work. I was on a WHV for circa 6 weeks waiting on the sponsorship visa to come through and I am being told that because of those 6 weeks I will be charged 65% on all of my super earned over the 3.5 years. I found a job in Sydney and they ended up sponsoring me on a 457 visa, I spent two years on that visa before I got a permanent resident visa, following on from my 457.&lt;BR /&gt;This was in June 2013. I got an email to say it had been received but that was it. My Superannuation company has told me they have not received the form yet.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I'm travelling for a few months and I don't have access to landline to call Australia to enquire about this.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Would really appreciate if someone could shed some light on this?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thank you,&lt;/P&gt;</description>

      <description>&lt;P&gt;Hi,&lt;/P&gt;&lt;P&gt;I applied for my DASP last year on Oct 2018 from two super funds and i got the refund within a week after providing the additional documents. This month i checked mygov account and found that only one super fund had paid me the money to the account whereas the other super fund didn't refund me. I contacted the super fund and they said they contacted me to provide additional documents and i didn't provide them the documents and they closed my file. I never received the email from them to provide the documents. They said to file for DASP again online and i went through the DASP online system and i couldn't file for DASP as it was already submiited last year. I told the super fund i couldn't do it online and they said me to fill and send the dasp paper application along with certified documents. I did what they said. Shouldn't they transfer my fund to ATO as it has been more than a year since i left Australia ? Are the time frame of paper application and the DASP online system the same ? What does the super fund do with the paper DASP application ? Do they send it to ATO to verify ? Please answer these questions as i am frustrated by the super fund in claiming my money.&lt;/P&gt;</description>

As per the details provided on form, it takes 21 days to complete this process.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Today is 15th October, allmost a month now but didn't received any update from them. Basically, I want to be sure that the filled form is correct.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I want to know is there any way to check the progress of submitted form 1194 from home affairs? Finally it is working but then Cbus send the member an email and said Cbus need a Power of Attorney and passport copy which must be certified. We asked the member to organise required documents which directly download from Cbus website stating&amp;nbsp;&lt;SPAN&gt;this form to give specific people access to your account details or authorise them to make changes for you. We also called Cbus directly to look for an advice to make sure the steps. After waiting the required documents finally are collected from overseas.       <description>&lt;P&gt;Hi All,&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Myself and my Mrs both have Austrlia PR (subclass 186) visa, which has now expired (Oct 2019).&amp;nbsp; We are British Citizens before this hence after spending just over 2 years we moved back to UK since last 4 years or so.&amp;nbsp; We dont intend to go back Australia to settle again etc(apart from holidays).&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;We both have Super with diff providers.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have been unable to find any info on how to claim the super back.       <description>&lt;P&gt;Hi there,&lt;BR /&gt;&lt;BR /&gt;I've made my DASP online application 6 months ago now.&lt;BR /&gt;&lt;BR /&gt;The ATO certifies that the DASP application has been submitted to my Super (AustralianSuper) but my Super fund denies having received anything from the ATO (And won't take any proof for answer, insisting they need to receive something from the ATO).&lt;BR /&gt;&lt;BR /&gt;I have now spent tens of hours and hundreds of dollars of international phone credits in an everlasting back and forth between both organisations, with the ATO stating they have already sent the application and can't do send a second one - and the Super fund insisting they haven't received anything and requesting information from the ATO.&lt;BR /&gt;&lt;BR /&gt;I'm getting frustrated and feel like I am getting nowhere, with multiple instance of an AustralianSuper operator telling me they have found the application - and the next time I follow up another operator telling me they don't have it and never have.&lt;BR /&gt;&lt;BR /&gt;I was wondering if I have any other recourse than legal action against AustralianSuper at this stage - as it seems I have exhausted all 'conventional' options?&lt;BR /&gt;&lt;BR /&gt;Thank you in advance.&lt;BR /&gt;&lt;BR /&gt;Mia&lt;/P&gt;</description>

The proof of identity is in some cases is an authenticated copy of their passport including an authenticated copy of the applicant's bank statements. The authentification has to be done by a Notary Public or Australian Consulate and translated to English and posted from overseas to the fund's postal address.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;As per the current rules and the recent changed in the legislation, the funds are requested to transfer the unclaimed super to the ATO after 6 months foreigners have left Australia, and have not claimed yet the DASP. However, on your website, there is not a clear instruction about when the foreigners have to provide certified documents to claim this money. This was paid out to me but was taxed at a much higher rate than I anticipated. I subsequently found out that this was because I was on a working holiday visa when I entered the country, even though I swapped over to a skilled 457 visa about 2 months into my stay, and remained on that visa for over two years. It seems ridiculous that I should be taxed at that extortionate rate on my super, even though I was only on that visa for 10% of my time in Australia. Surely there is a way to claim the reduced tax rate for the remaining 90% of my time on a 457 visa?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Any help would be much appreciated!&lt;/P&gt;</description>

      <description>&lt;P&gt;Hi there.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My partner and I completed our 2nd yr WHV early this year. Being eager to return to visit friends in March 2020, we already applied for our tourist visa.. We've come to apply for our super and realised this means we have an active visa! I'm aware we can cancel the current visa but i am wondering what implications this might have on future applications? We very much would still like to visit in March 2020 and so I dont want to cancel if this willl impact our future applications, but we would like to apply for our super soon!&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If anyone has any advice on this we greatly appreciate it!       <description>Acutally i got a replacement cheque draw by the ATO and previously same initial cheque draw by ATO also went missing in the postage process to my overseas mailing address,then ATO sent anonther replacment cheque to me and i processed the replacement cheque from my overseas bank account on 22 April 2019 via DHL mailing service but it went missing in the transit.And i did try to locate the cheque through DHL correspondence staff in Australia and they said we delivered the cheque on given destined bank address in Australia,but on the other hand bank claimed the cheque haven’t presented yet, since then the cheque went missing.Please kindly through the help of scanned copy of this cheque,do clear the cheque and transfer the fund in my overseas bank account.Please help pe out best you can.</description>

      <description>&lt;P&gt;&lt;SPAN&gt;Hello,&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;I have questions regarding super for non Australian citizen. I am currently here on a sponsorship visa (TSS 482) but I came to Australian on a Working Holiday Visa. I started working under this working holiday visa for approximately 6 months, during which I started cumulating money on my bank super. Then, I got my sponsorship but still got my superannulation umulated on the same bank account. However, I've recently been informed that any money placed under my original super will still be taxed as a super under a working holiday visa (65% taxation). &lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;Knowing that, I have now opened a new super account and have asked my employer to switch my superannuation to the new account. Ideally I'd like now to combine both super and move the totality of this previous super to the new account. However, before doing so I'd like to have confirmation that this is doable and won't just transfer the issue of the 65% tax. &lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;So, can you then confirm that, if I combine and move all the money from old super to new, this won't be considerate as a super under a working holiday visa anymore?&lt;/SPAN&gt;&lt;/P&gt;</description>
