      <description>&lt;P&gt;Hello, for the last finincial year I have been part time employed on wages and have worked part time as 'self employed' (sole trader). I am trying to work out how much tax I will be up for with my self employed income. Looking at ATO guides for self employed it says there is no tax for the first $0-$18,200. Will this still apply to me as I would be claiming the tax free threshold from my wages job (i've been working there for two years). I will have made over $18,200 so will be in the next bracket.&amp;nbsp;&lt;/P&gt;&lt;P&gt;Does my wages income affect what tax I will have to pay on my self employed income in any way?       <description>&lt;P&gt;Hi, I only just now found out from googling about various tax stuff that you need to submit a tax return even if your business only earned a dollar and it's well past October and I haven't heard anything from the ATO. I am wondering if I should try to lodge or not as I have an ABN and I made about $6 from my business as a sole trader in the last financial year, and if I would face a penalty for not realising. In fact I read somewhere a while ago that the tax free threshold for sole traders is $18,200 just like it is for individuals so am wondering if this is still true and if I still need to lodge a tax return? If I don't need to lodge, is it really necessary to file a non-lodgement advice as I have never submitted a tax return before. Also if I earn $0 but still have an ABN next financial year do I lodge a tax return or file a non-lodgement? And if I lose my ABN is there a way to advise this on a tax return so the ato knows I'm not a sole trader anymore if that were to happen? I would appreciate any help regarding this. I am also struggling to find information about whether receiving a government allowance increases that amount that you are taxed for your income or if your income is treated the same as someone who doesn't receive a government allowance?       <description>&lt;P&gt;I am a massage therapist and have just started my business working from home. I also have a part time job as an employee in an office admin role. I pay tax as an employee on that job and I will earn around $30k per year.&amp;nbsp;&amp;nbsp;I'm hoping to earn around $30k per year doing massage as well, bringing my total gross income to $60k.&amp;nbsp;I know I do not need to register for GST as my massage income is less than $75k.&amp;nbsp;However, I'd like to know how I go about calculating how much tax to pay on the massage income? The part time job is taxed at a lower amount as its only $30k but when you add it to the massage income, in total it will be in the higher tax bracket. So I'm a bit confused how it works and also how/when to pay it. Also, as a massage therapist working for myself from home, is that classed as PSI income?       <description>&lt;P&gt;Hi, I am Remedial massage therapist, and working in massage shop for a few years.&lt;/P&gt;&lt;P&gt;I have a ABN, and I give Tax invoice to the shop owner every 2 weeks and he pays me to my bank.&lt;/P&gt;&lt;P&gt;Pay is paid for 50% of massage I did, so it is commision style.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;so, my question is .. What is my employment condition..? Is this still self employed..?because I am working at only the shop and do reception work, cleaning..etc in addition with massage job. and I get paid only for 50% of massage I did. so.. If I were to calculate my estimated fuel and oil expenses using this method, do I need actual odometer readings for all business-related travel during the entire year (effectively meaning keeping a logbook for the whole year) or can I estimate the total distance travelled for business during the year based on the 12 week logbook as follows:&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;OL&gt;&lt;LI&gt;Calculate the business use percentage of the car using the 12 week logbook as per the link above.&lt;/LI&gt;&lt;LI&gt;Calculate the total distance travelled during the year using the odometer readings at the start and end of the year as recorded in the logbook (or by using the odometer readings when the car started and/or stoppped being used for business if it wasn't used for business for the full year).&lt;/LI&gt;&lt;LI&gt;Calculate the total distance travelled for business during the year by multiplying the total distance travelled during the year (calculated in Step 2) with the business use percentage (calculated in Step 1).&lt;/LI&gt;&lt;/OL&gt;&lt;P&gt;Given that the 12 week logbook period should be representative of travel throughout the year, this seems very reasonable to me. Is this ok?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;After this, the total fuel cost would be estimated as follows (and similarly for oil):&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;EM&gt;[Total distance travelled for business during the year (km) (calculated in Step 3)]&amp;nbsp;x [Estimated fuel consumption of car (L/km)] x [Average cost of fuel ($/L)]&lt;/EM&gt;&lt;/P&gt;</description>

Or is it counted as an expense to my business?&lt;BR /&gt;Or Is it when I withdraw the funds from my shares that I will pay tax in the financial year that I withdraw?&lt;BR /&gt;&lt;BR /&gt;Also, does it make my total taxable income appear less? Hopefully they're straight-forward, but I can't seem to find answers anywhere.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;U&gt;Scenario&lt;/U&gt;&lt;/P&gt;&lt;UL&gt;&lt;LI&gt;I start using my current car (Car A) for business use on 1 Nov 2019 and stop using it for business on 30 Apr 2020 because I buy a new car (Car B) and start using it for business use from 1 May 2020.&lt;/LI&gt;&lt;LI&gt;During the time I use Car A for business (i.e. 1 Nov 2019 to 1 Apr 2020), let's say the business use percentage is 60%. At all other times during 2019-20 (i.e. 1 Jul 2019 to 31 Oct 2019 and 1 May 2020 to 30 Jun 2020), Car A is used solely for personal use.&amp;nbsp;&lt;/LI&gt;&lt;LI&gt;From 1 May 2020, let's say the business use percentage of Car B is consistently at around 90% because Car A is used most of the time if I need to drive for personal use .&lt;/LI&gt;&lt;/UL&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;U&gt;Question 1&lt;/U&gt;&lt;/P&gt;&lt;P&gt;To work out how much to claim for car expenses using the logbook method,&lt;SPAN&gt;&amp;nbsp;&lt;/SPAN&gt;&lt;A href="https://www.ato.gov.au/Business/Income-and-deductions-for-business/Deductions/Deductions-for-motor-vehicle-expenses/Logbook-method/" target="_blank" rel="noopener"&gt;this page on the ATO website&lt;/A&gt;&amp;nbsp;says:&lt;/P&gt;&lt;OL&gt;&lt;LI&gt;Keep a logbook.&lt;/LI&gt;&lt;LI&gt;Work out your business-use percentage by&lt;OL&gt;&lt;LI&gt;dividing the distance travelled for business by the total distance travelled&lt;/LI&gt;&lt;LI&gt;then multiplying by 100.&lt;/LI&gt;&lt;/OL&gt;&lt;/LI&gt;&lt;LI&gt;Add up your total car expenses&lt;SPAN&gt;&amp;nbsp;&lt;/SPAN&gt;&lt;STRONG&gt;for the income year&lt;/STRONG&gt;.&lt;/LI&gt;&lt;LI&gt;Multiply your total car expenses by your business-use percentage.&lt;/LI&gt;&lt;/OL&gt;&lt;P&gt;If a car is only used for business purposes for part of the year, do I still include all car expenses during the income year in step 3? I can't find anywhere on the ATO website that provides further details about what to do differently (if anything) if a car is only used for part of the year for business purposes.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;U&gt;Question 2&lt;/U&gt;&lt;/P&gt;&lt;P&gt;&lt;A href="https://www.ato.gov.au/Business/Income-and-deductions-for-business/Deductions/Deductions-for-motor-vehicle-expenses/Logbook-method/" target="_blank" rel="noopener"&gt;The same page on the ATO website&lt;/A&gt;&amp;nbsp;says "If you want to use the logbook method for two or more cars, the logbook for each car must cover the same period. The 12-week period you choose should be representative of the business use of all cars."&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;What am I supposed to do for the scenario above where the two cars are used for business purposes at different time periods during the same financial year that don't overlap, and the business use percentage for each car is different?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;There are three options I can see for choosing the 12-week period, but none of them seem appropriate:&lt;/P&gt;&lt;UL&gt;&lt;LI&gt;&lt;STRONG&gt;Completely during the time I use Car A for business&lt;/STRONG&gt; (e.g. 1 Jan 2020 to 24 Mar 2020) - I recall reading somewhere that if you change cars during the year you don't need to do a logbook for the second car if the business use percentage doesn't change. However, in my scenario, the business use does change significantly so my understanding is that this option is not valid. In addition, it would disadvantage me since the actual business use for Car B Is significantly higher than Car A.&lt;/LI&gt;&lt;LI&gt;&lt;STRONG&gt;Partly before and partly after switching from Car A to Car B for business&amp;nbsp;&lt;/STRONG&gt;(e.g. 6 weeks before 1 May 2020 to 6 weeks after1 May 2020) - This would ensure that the business use percentage of Car B comes out more accurately (i.e. close to 90%). However:&lt;UL&gt;&lt;LI&gt;The purchase of Car B will occur shortly before the switch to Car B for business purposes so for most of the period before switching from Car A to Car B, I would not yet have owned Car B. The logbook for Car B would include this period (approximately 6 weeks in the example) where I had not yet owned the car. Presumably this is an issue.&lt;/LI&gt;&lt;LI&gt;The logbook for Car A will include the period after switching from Car A to Car B. Since Car A is no longer used for business during this period, including it in the logbook will reduce the overall business use percentage of Car A. If the answer to Question 1 is that I can claim all expenses for Car A during the income year (including before and after the period I used it for business purposes) then this may be reasonable. If not, it disadvantages me.&lt;/LI&gt;&lt;/UL&gt;&lt;/LI&gt;&lt;LI&gt;&lt;STRONG&gt;Completely during the time I use Car B for business&amp;nbsp;&lt;/STRONG&gt;(i.e. 1 May 2020 to 23 Jul 2020) - Not sure if this is ever valid, but either way it's similar to the first option where the business use percentage of the two cars are different.&lt;/LI&gt;&lt;/UL&gt;&lt;P&gt;So... what am I supposed to do?&lt;/P&gt;</description>

      <description>Hi asking for a friend, he has only recently linked his ATO to my Gov and has been going through the years online, he had the same tax accountant for about 11 years ( doesn't use them now ) he looked at all the letters from the ATO about his NOA and saw he was supposed to receive many tax returns that he never got, one was a cheque in his name and the others were EFT to his nominated financial institution. He had never given his accountant his bank details because he didn't trust anyone to have them,&lt;BR /&gt;Are they allowed to just nominate their own account or trust account for any payments to go into? And all the online letters he saw were posted to his accountants P.O Box , they never forwarded any returns or any letters from the ATO , he paid in advance for any tax or bas he did with them so no fees were owing to them, how would they be able to keep a cheque that is in someone elses name?? When challenged said agent emails me an excerpt form the LAW INSTITUTE JOURNAL November 2000. It was purchased for ~10,000 on top of a trade-in. Our clinic bills patients for work I perform on them. We have an agreement whereby I get a % of the billed amount on a monthly basis. The monthly invoice provided by the Clinic shows the following:&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp; Clinic Gross Earnings (GST Free)&amp;nbsp;&lt;/P&gt;&lt;P&gt;- Service Fee charged to contractor (Their %)&lt;/P&gt;&lt;P&gt;- GST on Service Fee&lt;/P&gt;&lt;P&gt;= Net Payable to myself&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;When preparing my BAS in respect to the above, can you please help with the following questions:&lt;/P&gt;&lt;P&gt;1. Do I include the total amount of Clinic Gross Earnings in G3 and G1?&lt;/P&gt;&lt;P&gt;2. If included in G1, would the answer to "Does the amount shown include GST?" be "N"&lt;/P&gt;&lt;P&gt;3. Do I include the Service Fee Payable in G11?&lt;/P&gt;&lt;P&gt;4. With the new MyGovID you can only verify your identity using an:&lt;/P&gt;&lt;P&gt;AUSTRALIAN passport&lt;/P&gt;&lt;P&gt;AUSTRALIAN birth certificate&lt;/P&gt;&lt;P&gt;AUSTRALIAN driving licence&lt;/P&gt;&lt;P&gt;or medicare card.&lt;/P&gt;&lt;P&gt;I have a medicare card but all my other documents are from the UK and you need 2 documents to identify yourself......this new system is flawed, I am sure there are other foreigners with ABNs who need to be able to use this system!&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;Hello all, I just had a few questions regarding my first tax return here in australia. I have been an australian resident for tax purposes for the entire tax year. I do a little graphic and web design as a sole trader on the side of my regular job. In the past tax year, I earned $24600 from my standard job and $5000 from freelancing. I also spent around $4400 in expenses &amp;amp; assets for starting up the business (computer, monitor, software etc). My questions are as follows:&lt;/P&gt;&lt;P&gt;1. As my income counts as PSI (personal services income), am I still eligible for the instant asset write off up to $20,000 for my business expenses?&lt;/P&gt;&lt;P&gt;2. If all of the expenses are eligible for the instant asset write off, will I still need do make a depreciation statement or plan for them?&lt;/P&gt;&lt;P&gt;3. I read that as the income is classed as PSI, I am unable to claim tax back on rent and rates for conducting my business from home. Am I still able to claim a portion of my Internet &amp;amp; phone bills that I use for my business?&lt;/P&gt;&lt;P&gt;4. Do I put down the amounts for monthly expenses (software) as one lump sum for the entire year on the return?&lt;/P&gt;&lt;P&gt;5. We have a form that was completed titled "&lt;STRONG&gt;2018-19 Australian Tax Return and Withholding Variation Application for foreign resident individuals competing at the 2019 Australian Tennis Open&lt;/STRONG&gt;." This form includes all Australian income for the tax year and applicable business expenses. Are there any additional filing requirements?&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If so, this is very difficult to work with if you aren't an Australian National. The client has attempted to link a myTax account to a myGov account, but it is not being allowed. Outside of that, the only option is to go through a registered Australian tax agent because all of the income is personal service income. No paper filing is allowed.&amp;nbsp;&lt;/P&gt;</description>

I have been making Bpay depoists to my sole trader name linked to the ATO thinking this was the correct thing.My new accountant, says that for year 1, I should pop this tax into my own offsett account andpay when the time is right. I can see how to deposit into the ato, but I cannot see how I actially get the money back, it is visible as a credit. Any suggestions ?&lt;/P&gt;</description>

I am an electrician and carry tools to work daily so i can claim my vehicle depreciation as well as all vehicle expenses by logbook method. However, i am wanting to start my own business whilt also working as an employee for primary income as i start the business.&lt;BR /&gt;&lt;BR /&gt;If i earn 75% of my income as an employee and 25% as a small business, how does this work with a $30,000 instant asset write off?&lt;BR /&gt;&lt;BR /&gt;I need to buy a new utility vehicle, tools, etc. So my deductions may come to $40,000 that i would intend to write off instantly. However, as the wnd od the tax year is fast approaching and i have not actually started the business yet, my deductions of $40k will most probably exceed the income generated by the small business. However my income as an individual will be far greater and i would like to use this deduction to reduce my taxable income as an employee also.&lt;BR /&gt;&lt;BR /&gt;Am i eligible to do thos as i meet the requirement for the instant asset write off as i am a small business entity however i am wanting to apply to deduction to my income as an employee where i am being taxed at 37-45 cents in the dollar.</description>

I rely upon the accounting software to help me lodge my personal tax return. I can claim home office running expenses (heating, cooling and lighting) by one of two methods:&lt;/P&gt;&lt;UL&gt;&lt;LI&gt;By splitting my energy bills into business and personal use amounts. The business use amount is based on the proportion of the floor area I use for business related activity and the proportion of the year that I used it for the business.&lt;/LI&gt;&lt;LI&gt;By using the fixed rate of 52 cents an hour for each hour that I operate my business from home - based on either actual use or a pattern of use.&lt;/LI&gt;&lt;/UL&gt;&lt;P&gt;If I decide to use the first method, accounting for these expenses in my accounts is reasonably straight forward. But what do I do if I want to use the second (fixed rate) method? How do I account for these expenses so that there is a link to the (fixed rate) expense tax deduction?&lt;/P&gt;</description>

My company owns and maintains a company car for business purposes.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Consulting occupies most of my time with across a range of industries and clients, however to help during quieter periods between clients my plan was for the company to make better use of the car and set-up ridesharing under the companies name (with me as it's Director and the driver).&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My salary would not change and I would not be claiming any personal expenses because my company would carry these expenses. The whole idea is a better use of the car and my time. However I was recently informed that the ATO would not allow my company to claim any of the vehicle related expenses before calculating the company tax liability at the end of the financial year and I must also set-up as a sole trader to do any ride-sharing.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I am very confused by this advice. I am a uber driver and I had bought the car before starting to drive for uber for $14000&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My question: We used the diminishing value depreciation method to depreciate the car. My accountant depreciated the car from the time I bought the car in 2015 and the time I started to drive in 2017. She sliced the depreciation incurred before starting to drive for uber and did the appropriate apportionment of the depreciation for the financial year. I noticed in the income tax return she mentioned&amp;nbsp;&lt;STRONG&gt;Other depreciating assets first deducted = $14000.&amp;nbsp;&lt;/STRONG&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Do I write the same amount of $14000 for this year's tax return as well? I am trying to understand why it is being done. Is it to keep track of the depreciation? From my experience this is only half true. I lodged my tax return and within a week&amp;nbsp; I got an assessment. However and this were it gets interesting, I decided to lodge an amendment and from my memory this was the 10th of this month. I still have not received a revised assessment. When I go into my MyGov account, I read balancing account. Am I PSI? I have done the tests which says I'm not but then the test continues on. It was a proper business, I setup an online store, took ABN and business name, bought $8500 worth of clothing from overseas in the intention of gaining profit. But ended up with no sale at all. My taxable income from working at Coles as an employee was $40,000 in that year. Since there is no sale activity, am I still eligible to offset the loss to income or defer it for later? Do I need to record it to MyTax in 2018 tax year to be able to defer in future?&lt;/P&gt;&lt;P&gt;Thanks in advance.&amp;nbsp;&lt;/P&gt;</description>
