      <description>&lt;P&gt;Hello,&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have recently left Australia after living few years, on a WHV, then on a 457 sponsor.&lt;/P&gt;&lt;P&gt;I have applied for a DASP and claimed my superannuation after cancelling my visa. The money was paid to me by my super fund last week, which I believe has also led to the automatic closure of my super account.&lt;/P&gt;&lt;P&gt;However, I had also filed a while ago a superannuation guarantee investigation against a previous employer which I had doubt about regarding payements of my super. This investigation was found in my favour and I've received a message from the ATO to inform me of it today.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The problem is I've already cancelled my visa and claimed my super back.&amp;nbsp;&lt;/P&gt;&lt;P&gt;Will I still be able to retrieve this money that is owed to me by the previous employer, and if so, how?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Many thanks,&lt;/P&gt;</description>

      <description>&lt;P&gt;Hi - I have been living in Australia since 2015 and I was on the 457 visa until April 2019. I used to have a overseas international expat health insurance and get my medicare levy back in full at the end of each tax here.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;- In March 2018 I have applied for permanent residency&lt;/P&gt;&lt;P&gt;- I kept my overseas international health insurance for the time being and did not register for medicare&lt;/P&gt;&lt;P&gt;- I got granted my permanent residency in April 2019 and applied for Medicare shortly after&lt;/P&gt;&lt;P&gt;- I was issued my medicare card early May 2019&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I was under the assumption that I would get back my Medicare Levy surcharge between June 2018&amp;nbsp; and April 2019 since I wasn't actually registered for Medicare. I filled out my Medicare Enititlement statement, however I got a rejection which said the following: ''your application for a Medicare Entitlement Statement has not&amp;nbsp;been approved. This is because our records show that you are already enrolled in Medicare&lt;BR /&gt;and have been issued the Medicare card.Your Medicare eligibility commenced from the date&amp;nbsp;you applied for permanent residency in Australia.''&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Does this mean I will not get my Medicare levy back? Although I wasn't enrolled in it for 10 of the 12 months of the tax year?&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thanks for your help.&amp;nbsp;&lt;/P&gt;</description>

When she switched visa.&amp;nbsp;&lt;/P&gt;&lt;P&gt;However is she viable for the tax freethreshold?       <description>&lt;P&gt;Hi,&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I hope someone can give me a clear answer as I can't help but get confused online.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I arrived in Australia on October 13th, 2017 with my Australian partner in the hope to move here. I am from the United Kingdom and the only way I could get in was on a 417 working holiday visa. I came in on this and started my Aussie life with my partner living in Brisbane and working as a contract graphic designer for half a year. After 6 months we decided to move to Melbourne where I continued to work as a contract graphic designer. I applied for a defacto (820 visa) which granted me a bridging visa which became active on October 13th, 2018. I have recently had my 820 granted (yesterday).&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I continued as a contract designer until February 2019 in which I took a full-time job with a design agency. I was under the impression that my tax rate would be that of an Australian resident due to the fact I am on a bridging visa and my intent to obviously reside permanently in Australia.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I also run a small side business offering my design services, most of which my income comes from back in England. I assumed I would be paying the tax on my UK earnings here in Australia. After speaking to my tax agent, he has informed me I either owe around $11,000 tax or around $4,000 tax depending on my residency status.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Could someone please let me know what the deal is. Am I taxed as an Australian resident being on a bridging visa which has now lead to my 820 visa being granted? If I am not and the ATO still class me as a backpacker on a 417 (what a joke that would be), surely I should not be claiming my UK earnings here and should pay that to the UK government?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thanks in advance and I hope it all makes sense.&lt;/P&gt;</description>

I have tried several times by answering questions specific to me but the system is not recognising my bank account or super account details. I rang the ATO and tried to get a linking code but was told that I can't because I don't have the documents to verify my identity.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I'm back in the UK now, I was on a working holiday visa which has now expired, as has my medicare card, and I don't have any of the other documents.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Not a clue how to get around this, any help would be much appreciated.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Cheers&lt;/P&gt;</description>

We are in the process of applying for permanent residency, however this will probley only be granted in the next 18 months. We have permanently relovated to Australia and I am an Australian resident for tax purposes.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have been performing some consulting work for an Australian company as well as my previous employer who is based in offshore. I will be reflecting this consulting income in my tax return and will be paying tax on it as this is Ausutralian sourced income.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have some offshore assets that generate income (ie. Interest and dividends), not Australian souced, and in additon to this I will be receving some commission payments for work performed prior to relocating to Australia.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My understanding is that this passive income, ie interest, dividends and commisision, is NOT taxable while I am still on a 482 visa.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Please can you confirm that my undesrtanding is correct and advise how these amounts should be reflected in my tax return when I file.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thanks&lt;/P&gt;</description>

      <description>&lt;P&gt;Hi,&amp;nbsp;&lt;/P&gt;&lt;P&gt;I am currently working on a 457 Visa which is about to expire; my employer will shortly be applying for a 482 for me. However, they have said I will need to pay for this by credit card during the application.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;They will then refund me the cost back minus tax and super. So out of pocket expense will be around $1300.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;As the reason for this visa is solely to be employed and produce income, is it classed as a tax-deductible cost to myself?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Cheers&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <title>Bridging A Visa Tax</title>

      <description>&lt;P&gt;I was on a WHV 417 which expired 22/11/2019. In the meantime I am on a bridging A visa while my application for TSS 482 visa is being processed. My understanding was that I would have the same work limitations and tax rates as my previous visa so 15% until 37,000 AUD.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My Payroll for my company say that my tax rate has changed from the 23/11/2019 (expiration of my working holiday visa and start of my bridging visa) and I am now an australian resident for tax purposes and jumped up to 32.5%. I have not reached the 37,000 AUD limit yet and I need some clarity on what tax rate I should be on as the process for this application could take a couple of months.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thanks!&lt;/P&gt;</description>

But I had a problem about my tax return.&lt;/P&gt;&lt;P&gt;I was working holiday visa from July, 2018 until 16, April 2019, and I got my student visa from 17, April 2019.&lt;/P&gt;&lt;P&gt;I know about tax rate is working holiday rate is 15% (0-$37,000) , 32%(over $37,000) and student rate is 0% (0-$18,200)&lt;/P&gt;&lt;P&gt;I was still working when I got student visa, and I still paid the 15% tax! But I didn't earn more than $18,200.&lt;/P&gt;&lt;P&gt;Do I need pay the tax after I got student visa? (I didn't earn more than $18,200)&amp;nbsp;&lt;/P&gt;&lt;P&gt;If I don't need pay that part of taxs, how do I get back? (Because I still paid 15% tax)&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Because I see the tax return detail about my return.       <title>WHV to (Bridging) Partner Visa</title>

      <description>Hi. I was curious about my tax calculation. I was going to lodge my tax but when I calculated it, it showed I owe $556.85 to ATO.&lt;BR /&gt;&lt;BR /&gt;So I was on WHV from on half of the financial year (July 2018 to mid Jan 2019) and then bridging visa (to get my partner visa) the rest of the financial year (mid Jan 2019 to June 2019).&lt;BR /&gt;&lt;BR /&gt;So I earned :&lt;BR /&gt;1. During WHV tax: $19,329.00&lt;BR /&gt;Tax withheld 15% : $2,982.00&lt;BR /&gt;2. Resident for tax purpose (bridging) : $16,365.00&lt;BR /&gt;Tax withheld : $2,444.00&lt;BR /&gt;&lt;BR /&gt;So TOTAL of my tax withheld during this financial year : $5,436.00&lt;BR /&gt;&lt;BR /&gt;However when I tried to see my estimate tax return/owed, it stated that I owe $556.85 to the ATO and also that my taxable income supposed to be $5,972.79.&lt;BR /&gt;&lt;BR /&gt;I got Non-refundable tax offsets as below:&lt;BR /&gt;Low &amp;amp; Middle Income : -$255.00&lt;BR /&gt;Low Income earner : -$445.00&lt;BR /&gt;&lt;BR /&gt;Also liabilities:&lt;BR /&gt;Medicare Levy $710.10&lt;BR /&gt;&lt;BR /&gt;I still don't get it how is this possible?&lt;BR /&gt;If I put all my earning to working holiday tax, I even would get about $100 return. If I put them all as resident, I will get over $1,700 return.&lt;BR /&gt;&lt;BR /&gt;I obviously got taxed 19% straight away for my resident for tax purpose earning even though I didn't get any tax-free threshold on my WHV.       <description>&lt;P&gt;Hi,&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have arrived recently from the UK on a TSS (Sub Class 482) Visa and I am just filling in the tax file number declaration form.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Question 7 on the form asks if I am an Australian resident or a foreign resident.&amp;nbsp; I assume I tick foregin resident, however please correct me if I am wrong.&amp;nbsp; I looked on your website and it states that I am classed as a temporary resident, but I am not 100% clear what category that falls under.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Also, Question 8 on the form asks whether I want to claim the tax-free threshold from my employer.&amp;nbsp; If I am on the TSS (Subclass 482) visa can I claim the tax free threshold?&amp;nbsp; I am only working in Australia and will not be working in the UK at all.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Please can you provide clarification on these issues.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Many Thanks&lt;/P&gt;</description>

      <description>Hi!&lt;BR /&gt;&lt;BR /&gt;I’m currently on a 485 Graduate Visa, but I’ve applied for the partner visa last year and was granted the bridging visa.&lt;BR /&gt;&lt;BR /&gt;My current graduate visa expires next year and I was wondering if this will impact my taxes. Friends of mine (who were on a working holiday visa before the bridging visa), were not able to claim the tax-free threshold on the bridging visa. &lt;P&gt;I have married my wife in Feb 2019 overseas and have applied for spouse visa (Visa 309) for my wife to join me in Australia. However, the visa has been currently being processed by Department of Home Affairs. She has not yet set foot in Australia yet.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;When I tried to lodge my tax return for 2018-2019 I was asked if I was married this year which I put a checkmark on "Yes". There are couple of questions about her tax such as:&lt;BR /&gt;- Your spouse's taxable income&lt;BR /&gt;- Your spouse's share of trust income on which the trustee is assessed and is not included in your spouse's taxable income&lt;BR /&gt;-etc&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;I think the correct amount in my case would be to put &lt;STRONG&gt;Zero&lt;/STRONG&gt; for all of those questions.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;However the one I am concered is this question:&lt;/P&gt;

&lt;P&gt;My wife was working a full time job overseas and as I mentioned above, she has never been in Australia before and does not have any bank account in Australia as well.&lt;/P&gt;

&lt;P&gt;shall I enter any income she earned during 2018-2019 on her overseas job in this part of the tax return form?&lt;/P&gt;

I got a tax agent to do my return but he simply cannot provide me wihth a straight answer. The forumns are not specifically helping with my query either.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The below relates to my final tax calculation and is exclusive of adjustements deductions or medicare levy. I have earned approximately 92,000 dollars and swapped Visas almost mid year. Below are three calculations for my tax that I have done. I have based them on three scenarios... one Full working holiday, one mid year swap (best) and one as a resident. Under option 2 I clearly get a massive tax saving which may seem unfair but was my impression day 1 entering the country and is why I did what I did.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I would be massively grateful if someone could clarify the situation. From my interpretation the ATO actually doesn't allow a tax free freshold if Option 2 is used and jumps striaght to the 32.5% tax when charging which seems wrong?       <description>&lt;P&gt;Hello, i'm Giovanni and on the 20th of November 2019 i finished my first Working Holiday Visa 417.&lt;/P&gt;&lt;P&gt;I would like now to come back to Australia from January and study General English first and then the Cambridge CAE course with a Student Visa until June/July 2020.&lt;/P&gt;&lt;P&gt;What i'm asking is how should I be taxed from now, since i've been taxed from the starting of the financial year 2019 normal 15% until November and then now coming back with a student visa until the end of the financial year.&lt;/P&gt;&lt;P&gt;Will the employer keep anyway the 32,5% of tax every payslip?       <description>&lt;P&gt;Hi,&lt;/P&gt;&lt;P&gt;My medical entitlement statement form was rejected&lt;/P&gt;&lt;P&gt;We enter in Australia on Student visa (sub class 573) with conditon - 8501&amp;nbsp;which means that you must maintain&lt;BR /&gt;adequate arrangements for health insurance (generally Overseas Student Health Cover)&amp;nbsp;while you are in Australia on this visa. which we did from our home country, currently on 485 graduate visa and maintain OVHC (Overseas visitor Health cover)&amp;nbsp;this year september we applied permanent residency visa and eligible to apply and get MEDICARE CARD from Centre link. when filing our tax return year 2018-19 needed medical entitlement statement to claim we weren't eligible for Medicare in 2018-19 financial year but&amp;nbsp;medical entitlement statement form was rejected.&lt;/P&gt;&lt;P&gt;we are UK citizen enter in Australia on student visa with private medical health insurance and didn't use Medicare service at all till end of 2018-19 financial year.&amp;nbsp;&amp;nbsp;&lt;/P&gt;</description>

Does anyone know is there any chance to change the class type at the last year's payment summary?       <description>&lt;P&gt;Hi all,&lt;/P&gt;&lt;P&gt;I have a situation.&amp;nbsp; A UK resident entered in Australia on a 90 days visitor visa in 2014.&amp;nbsp; He then applied for permanent residency on which he received a bridging visa while his application for permanent residency was in process.&amp;nbsp; He wasn't allowed to work under the visitor visa and he did not work.&amp;nbsp; When he received the bidging visa his situation changed.&amp;nbsp; he was allowed to to work and received a Medicare Card.&amp;nbsp; In 2019 he sold his primary place of resident in the UK.&amp;nbsp; During 2014 to part of 2019, the property earned income and was susequently declared to the ATO.&amp;nbsp; For the purpose of CGT, the cost base is the Market Value of the property on the day he turned resident for tax purposes.&amp;nbsp; I have difficaulty identifying that date.&amp;nbsp; I am thinking on the 183rd day from the date he received his bridging visa?&amp;nbsp;&lt;/P&gt;&lt;P&gt;Also, giving that the proprty was his primary place of resident, does the six year absence exemption applies to this property?&lt;/P&gt;&lt;P&gt;What are your thoughts?&lt;/P&gt;&lt;P&gt;Thanks in advance.&lt;/P&gt;</description>

I was advised to contact the payroll company to make an amendment so i can be taxed at the right rate on my WHV earnings. The company are refusing to make changes and not replying to my emails.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Am I able to make the amendment myself as i have all my visa documentation and payslips? My employer has never changed my visa status even thought the change of Visa had been informed. I had spelled out how much I had earned on each Visa to my accountant yet he still lodged my tax return as Working Holiday maker. Now, I understand that I am unable to claim their fault and fully accept what happened. However, I would like to know if the accountant could have prevented lodgin my tax retun inccorectly (as he had all the information he needed)?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My tax rate has gone up rediculously high even though my income is significanly reduced and I would like to see if my tax details are filled out right. If there was an error on my tax details, would I still be able to claim this and get my money back?&amp;nbsp;&lt;/P&gt;&lt;P&gt;(Hypothtically, if I was paying too much tax?) I'm on a 2 year working Visa since 2018 where I earned income from December 2018 - April 2019.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;I was a resident for tax purposes in Australia for the July 2018 - June 2019 tax year.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;I completed a tax return in Canada for the one month I worked during their tax year Jan 2019 - Dec 2018 (So just December 2018).&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;I have also paid tax in the current 2019 Canadian tax year which has yet to finish so I have not yet completed a 2019 Canadian tax return.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;I assumed I would still need to include the 2019 tax paid from Canada although not yet returned.&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;So based on that I calculated a foreign tax income of over $1000 thereby being required to calculate a foreign income offset limit.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;Here's where I get confused.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;I've followed the 'Calculating your offset limit' steps on your website, I've calculated my Taxable Income: $49,894 and my Foreign Income Tax Paid: $1,063.77 but the examples on your website don't show certain workings and where certain numbers come from or how to do it for my tax bracket ($37,001 – $90,000).&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;My questions:&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;Firstly, do I definitely need to include my unclaimed 2019 Canadian Tax in my Australian Tax Return? &lt;P class="paragraphsub"&gt;&lt;EM&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; (i)&amp;nbsp; the bridging visa was granted under the&amp;nbsp;Migration Act 1958&amp;nbsp;in relation to an application for a visa of a kind described in paragraph&amp;nbsp;(a) or (b); and&lt;/EM&gt;&lt;/P&gt;
&lt;P class="paragraphsub"&gt;&lt;EM&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; (ii)&amp;nbsp; the Minister administering that Act is still to make a decision in relation to the application; and&lt;/EM&gt;&lt;/P&gt;
&lt;P class="paragraphsub"&gt;&lt;EM&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; (iii)&amp;nbsp; the most recent visa, other than a bridging visa, granted under that Act to the individual was a visa of a kind described in paragraph&amp;nbsp;(a) or (b).&lt;/EM&gt;&lt;/P&gt;
&lt;P class="paragraphsub"&gt;&amp;nbsp;&lt;/P&gt;
&lt;P class="paragraphsub"&gt;&lt;SPAN&gt;The key word here are "or", namely subpara (c)(i) "and/or" which means that the subpara (ii) and (iiI) are to be construed in isolation from subpara (i). In conclusion, if you are on 417 or 462 visa, you apply for another visa and you are granted a brdiging visa, you will still be taxed under the 15% on the first $37,000 and then as residents for tax purposes.&lt;/SPAN&gt;&lt;/P&gt;
&lt;P class="paragraphsub"&gt;&amp;nbsp;&lt;/P&gt;
&lt;P class="paragraphsub"&gt;It also follows, the tax residency here is a separate issue. While the tax residency does not impact on the rate of tax of 15% on the first 37,000, it can bring about some benefits in the form of **invalid HTML removed**&lt;/P&gt;</description>

He remains an employee and is paid by his french company in France while he will be working in Australia. His salary will not be supported by the Australian offices as he will keep on working for the French team. He has been granted a Temporary Skill Shortage Subclass 482 (and so have I - as family). We will arrive in Australia around January 20 and we should go back to France (for good) mid August.&lt;/P&gt;&lt;P&gt;We are wondering how the 183 days test applies in our case as the income year in Australia starts in July.&lt;/P&gt;&lt;P&gt;It is not very clear for us as we will stay for about 220 days that are split over 2 different income years. Where are we supposed to pay taxes in such case? We have read the France-Australia Tax Agreement but the wording used is unclear in the French version.&lt;/P&gt;&lt;P&gt;Any help very welcome!! During this time period, I commenced my full-time employment in field of study. And when my visa was about to expire, my employer decided to sponsor me to remain in Australia and keep on working in my role.       <description>&lt;P&gt;Hello there,&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I am on a working holiday visa, and have worked as a sole trader with an ABN throughout my stay here in Australia so far, except for when I completed my farmwork to extend my visa.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I was wondering if it is possible for those on a working holiday to still setup a payment plan to pay their tax as a sole trader? I have earnt less than the $37000 first threshold for the 2018-2019 tax year, so as I understand it I should be taxed 15%? Is this also correct?&lt;/P&gt;&lt;P&gt;I have had to use money I saved for my tax for an emergency flight back to the UK for a family event so I am concerned about not being able to pay my tax in a lump sum, especially if I end up being taxed more than 15%. I've read that Aussie citizen sole traders can setup a payment plan, but I wanted to check if those on a working holiday visa who have been working as a sole trader are also able to do this.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Many thanks in advance to anyone who can advise me here!&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Sophie&lt;/P&gt;</description>

      <description>&lt;P&gt;&lt;SPAN&gt;For tax year 2018-2019, I worked 2 months on a WHV and 10 months as a resident for tax purposes.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;as the current tax law remains as follows;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;If you qualify for tax residency, then tax applies as follows;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;1. your WHM income amount should be adjusted to the period&amp;nbsp;earned when you were non-resident, the visa status/period is irrelevant.&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;2. You still pay 15% on this amount, more if over 37000.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;3. Your&amp;nbsp;income while resident for tax purposes will then attract Aus rates and offsets.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;5. The tax-free threshold of 18200 will also be reduce $395 per month for the period you were NOT a tax resident.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;7. As a tax resident you will attract the 2% medicare levy, but if not eligible for benefits you can exempt this by&amp;nbsp;getting an exemption certificate from Medicare.&amp;nbsp; No exemption if from a country with reciprocal benefit arrangements.&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;Therefore the tax free threshold for the income tax I earned as a resident should be 18,200-$395*2 = 17,410. &lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;Although when the ATO online software calculates my tax estimate it double counts my income as a WHM both at 15% and again as part of my income as a resident. My employment contract is permanent - my visa is valid for 4 years and is a medium stream visa which entitles me to apply for permanent residency after 3 years.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I am a German citizen and have previously been working and living in Germany. I arrived in Australia on 1 January 2019. My German work contract with my previous employer terminated on 31 January 2019, and thus I have earned income from employment overseas in the month of January 2019.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My questions are:&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;- Have I been a resident for tax purposes in Australia in the tax year 2018/2019? I have used the residency tool and understand the answer is yes but wanted to be sure.&amp;nbsp;&lt;/P&gt;&lt;P&gt;- If yes, do I have to declare my foreign income earned in Germany in the tax year 2018/2019 given my visa status?&amp;nbsp;&lt;/P&gt;&lt;P&gt;- If the answers are yes to both of the above, do I only need to declare the foreign income earned in January 2019 (since I definitely did not take up residency before 1 January 2019)? One of these employers sought registration to sponsor the employee but mucked up the application and it was rejected.&lt;/P&gt;&lt;P&gt;Currently on a bridging visa class WB/020 issued in May 2019 with an indefinite duration and which allows multiple entries to and from Australia; it also allows work but not for more than 6 months with any one employer.&lt;/P&gt;&lt;P&gt;Employee started with current employer on 1 July 2019 on a full-time basis as a landscape architect. Current employer has registered to sponsor the employee and intends to make the nomination application shortly. Migration agent advice is that the nomination should be successful. Assuming it is successful the current employment will become permanent.&lt;/P&gt;&lt;P&gt;Employee shares accommodation in Sydney but is not a lessee.&lt;/P&gt;&lt;P&gt;Previous employers applied 15% withholding tax on the basis of the employee working under the working holiday visa.&lt;/P&gt;</description>

      <description>&lt;P&gt;Hi&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have a client who entered Australia with a Working Holiday Visa 417 (valid for 12 months).&amp;nbsp; He came out with his partner to see if they would like to remain in Australia before taking any necessary steps to remain.&amp;nbsp; His partner came with him on a visitor's visa for 4 weeks before returning home and setting wheels in motion to return to Australia, although this took some 8-10 months to accomplish.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;During this time my client was enrolled into an English speaking course to learn the language.&amp;nbsp; He then went to work on a farm, and successfully extended his Visa for an additional 12 months.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;He subsequently found a job, and his employer is now currently taking steps to sponsor him to remain in Australia.&amp;nbsp; His partner has since returned to Australia having sold all their furniture and belongings and terminated the lease on their apartment.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Although my client came to Australia on a Working Holiday Visa, his intention was always to try to remain in Australia with his partner.&amp;nbsp; He has been in Australia for approx 16 months.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;So my question is, at what point will he be a regarded as being an Australian Resident for tax purposes, given he is currently here on a Working Holiday Visa until the sponsorship process is completed?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thanks in advance!&lt;/P&gt;</description>

The employer provided on PAYG summary for the 3 months with a H (this is correct), then a second PAYG summary with a H for approx 5 more months (this is in our opinion in error) then the final 4 months were tax as a normal resident and the PAYG summary is normal (no H). We would like to remove the H from the second PAYG summary up at item 1 on the tax return and only report the first 3 months of earnings at A4 . Is this allowable or should the Employer issue an amended PAYG summary?&lt;/P&gt;</description>

      <description>&lt;P&gt;Hi there,&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I would like to confirm the tax rates I can expect to pay over the next few years with regards to my situation as follows:&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;- Arrived in Australia Feb 2019 on a WHV class 417&lt;/P&gt;&lt;P&gt;- Currently being taxed 15% WHV rate for a casual job&amp;nbsp;&lt;/P&gt;&lt;P&gt;- Set up a sole trader business due to begin trading Sept 2019, will cease my other job soon after I begin trading and drawing a profit&amp;nbsp;&lt;/P&gt;&lt;P&gt;- In process of submitting application for partner visa here (have been with my Australian partner for over 10 years)&lt;/P&gt;&lt;P&gt;- Once I submit application for the partner visa, looking at the IMMI website it appears I will remain on my WHV (and subsequently the WHV tax rates) until that "substantive visa" expires (Feb 2020).&lt;/P&gt;&lt;P&gt;- Then I will switch onto a bridging visa until my partner visa is approved (current processing times 22-26 months), during this time I understand I will still be on WHV tax rates? Is this correct?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;From the above, it looks as though I (and subsequently my sole trader business) will be on WHV tax rates for probably my first 3 years in Australia. Are they just the foreign residence tax rates? Do I need to withhold any tax? Or does my employers need to withhold any tax?       <description>FY17/18&lt;BR /&gt;I came to Australia with the intention of staying. I had a 417 WHV from 9/07/17, a bridging visa from 14/12/17 and a 457 from 23/04/18.&lt;BR /&gt;&lt;BR /&gt;1. What date do I become resident for tax purposes?&lt;BR /&gt;&lt;BR /&gt;I earned $50k while on WHV, $30k while on bridging visa and $20k on 457 visa.&lt;BR /&gt;&lt;BR /&gt;2. Do I receive a tax free threshold pro rata for 3 months? (13464 + 4736 × 3/12)&lt;BR /&gt;&lt;BR /&gt;3. If so will this threshold be offset against my 457 income of $20k even though I have earned $80k on whv/bridging?&lt;BR /&gt;&lt;BR /&gt;4. Can i claim medicare levy exemption for the days I was not resident for tax purposes?</description>

      <description>&lt;P&gt;You do not need to ask for our permission to work with same employer if...&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;UL&gt;&lt;LI&gt;be self-employed and provide services to the same business for more than six months as long as that business is not the only business you provide services to during that time&lt;/LI&gt;&lt;/UL&gt;&lt;P&gt;The situation is that&amp;nbsp;I originally worked for an employer with my TFN number for almost 6 months now.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have now also found another job, successfully applied for an ABN as will be contracting my services to a new company and also contracting my services through my ABN to my previous employer that I've almost completed 6 months with.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;As per the above bullet point can I continue to work for my previous employer (beyond 6 months) on my ABN because it will not be the only business I am providing my services to and will also be providing my services to this new business as well?&lt;/P&gt;</description>

      <description>&lt;P&gt;When I first come to Australia in 2014 I was on a working holiday visa, I then got sponsored and when my sponsorship was expected I opened a super account , from that first year I think the super witch I earned ( wouldn’t have been much got rolled in to the essential super account I opened) this was from different employers since then I stayed in the country another four years on a 457 visa, I have now left and my visa is still active but everything I’m reading is saying I’ll be taxed 65 percent because of the working holiday visa surely this can’t be true our there has to be a way around it seeing I opened the super account after my 457 was excepted please help ,!&lt;/P&gt;</description>

      <description>&lt;P&gt;Hi Team,&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I was in Australia for a period of 3 weeks in the month of Feb'19 under a business visa subclass 400. Upon return i filed for early returns. I was taxed at 3.25$ per dollar earned. However when my colleagues who were there for the same period filed using the online method, they got the entire amount back. Unsure how this works? The only difference in what they filed and i sis was that the online option had a section to update if you were a resident for tax period and fill the date in (The selected NO and added the duration for which they were there). I didnt have that option in paper returns. Also when i try to amend it online, there is no such option available. Requesting some sort of guidance on the same.
