Hi Chris
Thanks for answering my question however I’m still a little confused.
I chose the cheque option for my DASP as I no longer have an Australian bank account however I am still waiting for this. I have received a PAYG payment summary document but no cheque. Does this arrive separately?

Thanks
Kirsty

Hi <LI-USER uid="26931" login="Sagar1"></LI-USER>

Thanks for your post.

This is something that is frequently asked in our Community. You can find the answer to your first and third questions in the following thread: Claiming DASP as former permanent resident

Regarding your second question, if you are eligible for a DASP it will be taxed in accordance with the applicable DASP tax rates. You can find out more about how DASP is taxed on our website.

Assuming that you haven't held a working holiday maker (WHM) visa (the visas that you have mentioned aren't WHM visas), the DASP ordinary tax rates will apply. You can check out the DASP for working holiday makers page for more information.

Hope this helps.

Thanks,

Hi <LI-USER uid="26893" login="Kirstymonington"></LI-USER>

Thanks for your post.

A DASP can be paid electronically or via cheque. How yours was (or will be) paid depends on what you selected in your DASP application as well as who was holding your super money.

There are three possible payment options:

electronic funds transfer (EFT) to an Australian bank account

cheque

international money transfer (IMT) – for fund applications only.

If we held your super money, we will only pay your DASP to you via EFT to an Australian bank account or cheque. Super funds can also use IMT but whether they offer that option depends on the fund.

For more information about how and when DASP is paid, you can check out our website.

If you can't recall the option you chose, you may need to get in touch with either your super fund or us depending on who was holding your super money. Refer to our website about how you can contact us about your DASP.

Hope this helps.

Thanks,

We're sorry to hear that your application has been held up. We don't know what is happening on this platform as we don't have access to your records.

We would advise against reapplying for your DASP as you already have an application and this could cause further hold ups. The 28 days is just normal days, not business days.

Hi ATO community,

I woud like to enquire about whather it is viable/ reasonable to withdraw my superannuation once I've left Australia even though I intend on returning to Australia as a student. I am currently holding a student visa, which will be expiring this coming March 2020 after completing my undergradate studies. I have decided to take some time off before going into posgraduate studies in 2021. As I will not be in Australia for roughly a year and will be on an expired visa once I have departed, I am wondering if withrdrawing my superannuation would affect future visa applications, including those that lead to permanent residency. I am planning on applying for PR once I have completed my posgradtue studies, yet I am unsure as to whether I would be allowed to claim my super again in the future? Would claiming my super after my departure impact my right to work?

It would be highly appreacited if anyone could provide me with some information in regards to this.

Sincerely,

Nic

Hi <LI-USER uid="26658" login="VeerleVerlooij"></LI-USER>

Thanks for your post.

From what you have advised, it sounds like your super fund has applied the tax correctly.

When they processed your application, they would have checked whether your DASP included amounts attributable to contributions made while you held a WHM visa. When it does, they are required to apply the 65% tax rate to the taxable component.

In other words, the DASP WHM tax rate applies to the entire payment, including any super you may have earned while working under a different visa.

For more information about DASP for working holiday makers as well as how DASP is taxed, you can check out our website.

Re: DASP Super not paid by employer

Hi <LI-USER uid="26292" login="hp111716"></LI-USER>

Thanks for your post.

If we are holding some super guarantee (SG) for you due to your former employer's late payments, you can submit a DASP application now if you like. In saying that, it may be more practical to wait until they have completed their payment plan.

Of course this assumes that you meet all of the DASP criteria. You can find out more about your eligibility for DASP on our website. You might also want to read up on how and when DASP is paid as well as how it is taxed.

If you have any reason to doubt what your former employer has said, you may want to check out the unpaid super from your employer page. It explains what your options are.

Hope this helps.

Thanks,

Hi <LI-USER uid="26121" login="UK-M-482-Visa"></LI-USER>

Thanks for your reply.

If you end up having accounts with two super funds, the DASP tax rate will be determined by each super fund separately, as each super fund is making their own payment. In turn, you will receive two DASPs.

Based on your scenario, your older super account will hold contributions that are attributable to when you held a WHM visa. This means that your older super fund will need to withhold the 65% DASP WHM rate from your payment.

Assuming that you don't rollover any of the super from your older super account into your new super account and you remain on a non-WHM visa, the lesser DASP tax rates will apply to any DASP paid from your new account.

For more information about how DASP is taxed, you can check out our website.

Hi <LI-USER uid="26597" login="Alexhhh"></LI-USER>

That does sound very frustrating.

When you first entered the DASP online application system, you should have been asked to create a 'shared secret' by selecting a question and supplying an answer. Whenever you revisit the system, you'll need to provide your personal details and answer the question that you created correctly.

For more information about re-entering the online system, have a look at our website.

If you weren't given that option when you first entered, or you were but you're not being given the option to answer the question when you re-enter the online DASP system, you have a couple of options.

One option is to start the application again which we understand may be annoying but will likely be the quickest way of going about it. Alternatively, you can send an email to our DASP team so that they can look into it for you.

If you would like to take up the second option, you can find the email address as well as the information that we will need from you at the bottom of the help with the DASP online application system page.

Hope this helps.

Thanks,

My question is: Can I submit a DASP application to claim my super if my employer has not yet paid all of it to the ATO? and would this be ATO held super?

Thanks

Hi Chris,

Thanks so much for your response, its quite stressful when this information isnt made entirely clear on the government site.

Still a little confused however. I understand that transferring non WH contributions will result in me still paying 65%.

But If I simply open a new super fund with a different provider and do not transfer anything, will that result in me paying the lower rate from that point forward?

At this stage i'm just looking for directions on how to pay the lower rate from now on, with future contrubitions

Any additonal advice you can offer would be greatly appreciated.

Many Thanks,

Elliot

Hi <LI-USER uid="26121" login="UK-M-482-Visa"></LI-USER>

Thanks for your question.

Your understanding about how a future departing Australia super payment (DASP) will be taxed is correct. Your current super fund will be obliged to apply the 65% tax rate to the entire DASP even though only some of it relates to contributions made when you held a working holiday maker (WHM) visa.

For more information about DASP for working holiday makers, have a look at our website.

You won't be able to avoid paying the 65% tax rate on your non-WHM contributions by transferring your non-WHM contributions to another super fund. This is because your new super fund won't know that they are non-WHM contributions.

When your current super fund arranges the rollover (assuming they are happy to arrange a partial rollover), they will be required to provide a statement to your new super fund. Amongst other things, that statement will detail the tax components and the service period start date but not the contribution types or dates.

For more information about what your super fund will need to do, check out the reporting to receiving funds and members page.

When your second fund receives your future DASP application, they won't know the specifics of the contributions received by your first fund but they will know the service period start date. The Department of Home Affairs will also confirm when you were the holder of a WHM visa. You can probably see where this is going.

While you can't avoid the 65% tax rate on the contributions that have been made so far, assuming that you remain on a non-WHM visa, any future contributions made into an account with a different super fund will be taxed at the lower rate/s.

Hope this helps.

Thanks,

Hi <LI-USER uid="26073" login="Dooleybug"></LI-USER>

The error message that you have received means that the Department of Home Affairs has been unable to establish that you were the holder of a temporary resident visa.

If the visa that you held was definitely a temporary visa that has since expired or been cancelled, we recommend that you get in touch with Home Affairs to confirm the status of your visa. It may be something that can be easily fixed.

You can find the Home Affairs super email address by referring to the help with the DASP online application system page on our website. Our email address can also be found on this page if you need to send a DASP query to us.

Submitting your DASP application is certainly a lot easier. If you decide to submit a paper application instead, you will need to obtain a Certificate of Immigration Status from Home Affairs because the value of your super is $5000 or more. That threshold isn't based on how much your DASP will be after the tax has been applied.

Hope this helps.

Thanks,

Re: DASP payment 2011-14: mix of 417 and 457 visa

Hi <LI-USER uid="26072" login="Paulo19"></LI-USER>

Thanks for your question.

The tax rate (or rates) that you will pay on your DASP will depend on a couple of things including the type of visa you held when in Australia as well as the payment's components.

For more information on how DASP is taxed, have a look at our website.

You mentioned holding a working holiday visa for the first few months of your employment. You will be considered a working holiday maker (WHM) if that visa was a 417 (Working Holiday) visa, a 462 (Work and Holiday) visa or an associated bridging visa.

You can read more about the DASP for working holiday makers on our website.

If you have more than one fund, the DASP tax rate will be determined by each super fund individually, as each super fund is making a separate payment.

Each fund will check whether the DASP includes amounts attributable to super contributions made while you held a WHM visa. If it does, they will apply the 65% DASP WHM tax rate. If it doesn't, they will apply the DASP ordinary tax rate/s.

The 38% rate that you have mentioned is no longer applicable. It was only applied to DASPs paid from 1 July 2014 to 30 June 2017.

Hope this helps.

Thanks,

You would only be able to take the super out if you have met a condition of release.

Hi <LI-USER uid="25849" login="acoppa"></LI-USER>

Thanks for your reply.

From what you have advised, it seems as though you will be able to submit a DASP claim after your permanent visa expires next year. It would be reasonable to assume that the temporary visa that you held has well and truly expired!

As mentioned in my previous post, for those who don't qualify for a DASP, they simply have to wait until they meet a different condition of release to access their super. In the meantime, it simply stays in their super account until it can be claimed. They don't lose it.

Hope this helps.

Thanks, ChrisR

Claims / Tax on Super under a 482 Visa

I had a query with regards to Super that I was hoping you could assist with.

When I first arrived in Australia in 2017 on a Working Holiday Visa, I created a super fund when joining my current employer. I eventually switched to a 482 Visa in 2018.

From what I understand, If I choose to leave Australia in the future, all of the super I have earned to date will be taxed at the Working Holiday rate of 65%, which is naturally quite alarming.

Can I avoid this by simply opening a second fund and transferring what I had earned on the 482 Visa? Some of the existing threads on here seem to indicate this might be the case.

Any Advice would be greatly appreciated.

Questions regarding my DASP, an error online and whether certification is required

Hi there,

I have left Australia and recently my visas have expired, I'm now overseas and have had some difficulties with processing my DASP to get my super funds, I've tried calling from overseas but with the phone expenses I can't afford to stay on hold for too long unfortunately.

Firstly, many of my friends processed their DASP through the online application, when I try I am presented with the following error message, which nobody else has seen:

Not eligible - not known

Based on information supplied to us by the Australian Department of Home Affairs we are unable to establish that you are the holder of a temporary resident's visa under the Migration Act 1958. If you are the holder of a temporary resident's visa under the Migration Act 1958 check the details you entered are correct, then try again. Alternatively, you may send a paper application.

To clarify, I was on a 2 year WHV and following that a student visa. All of which have now finished, I have confirmed with my super that my account with them is still open and has not been transferred to the ATO.

Because of this error I figured I might have to do the paper application which seems to have more information required. The second question I had was regarding getting a certificate from the Department of Immigration. It states if I am due to receive over $5000 this will be required, if not I can just show evidence I've left the country. In my situation, my current super savings total over $5000, however once the 65% tax is applied it will definitely be under that value. Does that mean I can just provide my own evidence I've exited the country, therefore avoiding further fees for a certificate and a 21 day wait time for this to be sent to me. (My friends mentioned this is something they didn't have to do during the online application)

Ideally if there's some way the online application error can be resolved I'd do it there, since it took my friends considerably less time and effort, but ultimately I'm just trying to lodge my super returns quickly and without mistakes.

Thank you!

Hi all,

I am looking for some help.

I am in the process af applying for DASP and am confused by the rate of tax I will pay. I was employed between Sept 2011 and Aug 2014. Between Sept 2011 - Feb 2012 I was employed on a working holiday visa which switched to a Business Long Stay 457. I was employed on this until I left Australia in Aug 2014.

I have read confusing info about the rate of tax that will apply. Some say 38%, then others either 35% or 65%.

C

Update from me:

Because of a late payment from the last employer I had to lodge another application to get that little bit of money paid out and as this was into another account, opened while I was on another visa but WHV, I can taxed the smaller amount.

So warm advice for every WHV holder - if you stay longer on other visas, open a new account when on the other visa!!! Don't consolidate those two. Then it should, in theory work as it did for me with my last payment. Wish someone had told me back then....

If you had a different super fund when you were on a 457 visa then you wouldn't be subject to the 65% WHM tax for the DASP paid by that fund. It's important to note that the DASP tax rate is applied on a per-super-fund basis.

Hi <LI-USER uid="25849" login="acoppa"></LI-USER>

Thanks for your question.

This one comes up quite often and there are a number of threads in our Community that you can look at. Here is a link to one of them: Claiming DASP as former permanent resident

It is important to note that your eligibility will depend on whether you held a temporary visa (which has since expired or been cancelled) prior to your permanent visa. If you have only ever held a permanent visa, you won't be eligible to apply for a DASP.

If you're not eligible for a DASP, you can check out the conditions of release section of our website for more information about when you can access your super.

Hope this helps.

It seems quite ridiculous that I would be taxed at 65% for 5 years of earnings, when I was only on the WHM visa for 3 months, in 2015 (before the law changed). Can you please confirm that all of my super will be taxed at the higher rate? It's not even possible to be on a Working Holiday visa for 5 years.

I would understand if my super earned whilst on the WHM visa was taxed at a higher rate, but not the super earned on a 457 visa.

Hi,

I am planning to leave Australia at the end of my current 485 visa and I want to claim my Super after I have left. But, I am planning to come back to a dependent visa after my partner gets her 485 visa granted or if I get selected for 189 or 190 visas.

My question is, can I claim my super after I have left Australia and still come back in one of the visas mentioned above and work here again?

Thanks,

Lawrence

Hi <LI-USER uid="25789" login="canadian_worker"></LI-USER>,

<LI-USER uid="1386" login="macfanboy"></LI-USER> is mostly correct here, just the last sentence needs clarifying.

From 1 July 2017, the new DASP WHM tax rate of 65% applies to DASPs made to WHMs where it includes amounts attributable to superannuation contributions made under a WHM visa.

It does not matter when you held a WHM visa. If you have ever held a 417 or 462 and associated bridging visas and the DASP includes amounts attributable to super contributions made while you held the relevant visa, the DASP WHM tax rate will apply.

The DASP WHM tax rate applies to the entire payment, including any super you may have earned while working under a different visa.

See: https://www.ato.gov.au/individuals/super/in-detail/temporary-residents-and-super/super-information-for-temporary-residents-departing-australia/?page=5

If you have held a WHM visa, your super fund will check whether the DASP includes amounts attributable to super contributions made while you held a WHM visa. If it does, the super fund will apply the DASP WHM tax rate. If it doesn’t, the super fund will apply the DASP ordinary tax rates.

Pretty much self-explanatory.

A higher rate for when you received super under the WHM visa and lower one when you were not.

I was on a WHM Visa in early 2015, at which time my Super account was created and my employer started making contributions. After a few months, I was sponsored on a 457 visa and have remained on a skilled work visa for 5 years.

Now I am leaving Australia and going through the process of claiming my super back. What rate will I get taxed at? I have read about 35%, 40%, and 65% tax rates, and I'm concerned that I will be slapped with a higher tax rate even though I was only on the Working Holiday visa for a very short time.

Thanks for any advice

My question specifically relates to the treatment of the tax free elements which, if they are not taxable, I am assuming would not be subject to foreign resident tax rates.

Hi all!
I was in Australia on a Working Holiday VISA for 1 year (October 2018-October 2019). After my WHV expired, I went to Bali for 1 week and then came back into Australia on my Tourist Visa (601/ETA). I left the country for good on November 17th 2019. I’m now back in England and want to claim my super back... but my ETA lasts for 1 year and doesn’t expire until October 2020. I have phones immigration to ask if they will cancel the visa so I can claim my super - they said they can’t. I then phoned the ATO who were absolutely useless and said there was nothing that could be done. I’m at a loss now about what to do. I imagine this MUST be the case for a few people who return after their WHV has expired...

Please help!!

As well as looking at the great information from <LI-USER uid="1386" login="macfanboy"></LI-USER>, you can check in case you qualify for DASP if you were ever a temporary resident.

Hi,

I came to Australia in 2007 on a Working Holiday Visa - 457 i think - and then transitioned to a spouse sponsored visa. Then I got permanent residency in 2013 but left Australia in 2013 and have not returned since. The permanent residency has expired and I still have quite a bit of money in an ANZ Smart Choice super account. I have the membership number and spoke to a person in ANZ last year who gave me the balance but no details on how to withdraw it. I've tried the onlie ATO DASP process but do not have the product details of the account this has identified i.e. SPIN, start date, etc. Is there a paper based form i can use or a specific dept within the ATO that I can speak to or do I have to liaise with ANZ direct? Thanks.

Hello Team,

Background: Under 457 WP visa and has a super fund managed by a local financial company. Also, no Super contribution after 1st Jan 2017.

Questions:

1. What will be the tax rate at the time of Super withdrawals (say: I have $10,000 then how much I will get after tax)

2. Can I keep my Super (managed by a financial company) after leaving Australia until reaching preservation age bracket?
3. If answer is yes to Q2, then what will be Super withdrawals tax rate during/after the preservation period?

Thanks much for your response.

Kind Regards,

Debasis

If you are a former temporary resident and have returned to Australia on another temporary visa you will not be able the submit a DASP claim until you have departed Australia again and cease to hold any active Australian visas, including both work and non-work visas.

Department of Home Affairs verify your immigration and visa status. If they identify that you hold a valid temporary visa the DASP system will prevent you from submitting a claim. Eligibility criteria is on our website.

I hope this helps. Thanks, NateH

Hi <LI-USER uid="25206" login="LeonT"></LI-USER>

It depends if someone is submitting an online or paper claim.

If someone applies for DASP using our online system, their identity is verified using our matching rules so their super fund doesn't need further identification documentation. However, their super fund can request additional information if needed.

If someone submits a paper application for DASP to their super fund, they need to include certified copies of the following:

Evidence of their immigration and visa status

Proof of identification (regardless of the value of the withdrawal benefit)

Working holiday maker (WHM) visa information

The taxed element of the taxable component includes amounts that the fund has paid tax on, for example, taxable contributions and fund earnings.

The untaxed element of the taxable component includes amounts (other than the tax-free component) that the fund hasn't paid tax on. This happens when part of the super lump sum comes from a scheme that's not subject to tax.

Permanent residents can withdraw super:

when they turn 65 (even if you haven’t retired)

when they reach preservation age and retire, or

Hi,

I found what I understand may be a discrepancy between the information provided on the ATO web site and the SIS regulation regarding proof of identification for DASP. I would like to hear someone’s opinion, please.

In reference to DASP payments the ATO web site states that a benefit payable under SISR Schedule 1 item 103A by the super provider must meet the requirements set out in SISR regulation 6.20A. It also states that if the withdrawal benefit is less than $5,000 you (I assume, a superannuation fund) don't need to undertake the client identification procedures required by the Anti-Money Laundering and Counter-**bleep** Financing Act 2006

However, SIS regulation 6.20A States that If the member's withdrawal benefit in the fund is less than $5 000, the trustee of the fund must receive:

(b) a copy of the member's passport showing that the member has left Australia.

Also AUSTRAC, states that as a reporting entity we must apply customer identification procedures to all customers, which contradicts the above statement from the ATO.

I’m assuming that we need to error on a side of caution and request client’s ID for all DASP payment.

I contributed to a superannuation fund for all my working life in Australia (Australian citizen). I have since moved overseas and would like to withdraw my superannuation after my preservation age but before I am 60. Do I still have to pay tax on the taxable amount even though I no longer reside in Australia?

Effect of closing super account after moving overseas

Hi all,

this is my first question in this community and I hope to have chosen the right section to post.

I have left Australia a while ago but I have left my super account open with all the contribution in it. The reason why I haven't closed it so far is that I have been told that once I claim the contribution back and close my super account, I will not be allowed to enter Australia as a worker anymore (i.e. with a sponsorship), since opening a new super fund under my name will not be possible. Is this true?

Thank you.

Thanks for getting back to me Hailey. Unfortunately I am unable to find an answer in DASP website or from my superannuation fund about the eligibility criteria. My work permit has expired. I have a new valid business visa, does this prevent me from withdrawing the funds?

Any help is greatly appreciated.

Thanks,

Aravind

I am a non-resident French-citizen, working a few weeks per year in Australia under a 400 visa (Temporary Work - Short Stay Specialist). I have a super, funded for me by my company. I expect to be around 60 years old when my current project is over and I no longer have to work in Australia.

If understand correctly, I shall then have the opportunity to have my super paid to me as a DASP at that time, in which case it will be subject to a 35% tax.

Does it make any difference for me if I wait five more years to claim my super, when I am 65. Would it then be free of the 35% tax?

DASP is directly related to visas. Applications are dependent on certain visa criteria. I don't think it was unreasonable of me to assume that people with insight about claiming DASP would know about how visas affect these claims, and if googling it had given me an answer then I wouldn't have posted on here.
