Hi,

I have made voluntary contributions to super over the last few years with the intention of withdrawing the funds to buy a new home as I meet the first home buyer requirements.

Back in January we signed a contract to purchase a house (currently under construction) and take ownership in November when the home is completed. However the wording for the scheme states that i must apply for the money within 90 days of signing a contract, which i have not done.

Can I still apply for the funds? I did not notify the ATO of the contract because we thought this just had to be done prior to settlement.

Hey @Matt.....,

 

Our experts confirmed, since you didn’t apply within 90 days of signing the contract, you may have missed the standard FHSS deadline.

 

But still worth calling us directly and asking if you can still apply for the determination, as you've not officially settled (Been handed the keys) yet.
