The purchaser of the off the plan property was trying to apply for FHSS determination. The salary sacrifice for FHSS amount recorded in my gov account did not iinclude yet the FHSS contribution for March 2021.Can he submit the determination for only the amount received by ATO and then asked for the remaining amount to be remitted by the employer later in April 2021? How can he withdraw the remaining amount? What is the procedure for this?

We assume a property purchase contract is being signed before the super fund is due to receive the salary sacrificed contribution. If so, the first home super saver (FHSS) determination should be requested before the contract is signed, but it can't include the salary sacrificed contribution.

 

If they want to access this contribution via the FHSS scheme, there are a couple of obvious options. They could delay the contract signing or they could ask their employer to make the contribution sooner than planned. Depending on timing, they may need to do both.

 

If the salary sacrificed contribution can't be included in their determination and release requests, they can't access it via the FHSS scheme.

 

We note that you've mentioned an off the plan property purchase. Eligibility for the FHSS scheme depends on the terms of the contract and the state the property is located in. You can send an email to SuperAdvice@ato.gov.au for further advice on this.
