If I'm still legally married to my ex husband (haven't divorced yet) but we have been seperated all financial year, do I still need to list him as my spouse for tax purposes?

 

If the answer to this is yes, then how does he then list his new defacto spouse whom he lives with also?

If you have not legally lived with your ex husband in the past financial year you shouldn't need to include him on your return. You can check out a similar post we have answered on our forum, this should alleviate your concerns and provide you with the information you need.
