Our accountant has been postponing our SMSF tax return preparation.

Finally we saw no option but to change our tax agent. The new accountants have prepared all the statements to start audit and lodge tax return for us,   but also require our permanent SMSF documents.

Unfortunately we do not have those documents handy as our former tax agent has collected them to make a copies and never returned maybe due to restrictions related to Covid19.

Now former tax accountant has been playing it hard and not returning documents. Keeps making promises and breaking them. Sending us mixed messages. 

We need to extend our SMSF  tax return lodgment due date because of it. How can apply for extension?

Our accountant has been postponing our SMSF tax return preparation.

Because the auditor cannot issue an unqualified audit report without seeing the trust deed, as well as certain prior year and startup documents.

The former accountant should give them to you, because what will happen if you made a complaint to ATO.
I am wondering whether the reason for delay might be that the documents cannot be found.
 
Make a time to go there and pick up the documents  -  if you cannot get them,
ring ATO on 13 10 20 and explain the position you are in.

You an ask ATO on 13 10 20 about that, but I do not think that is your main issue.

Any penalties should be recovered from whoever caused them.

 

You should also contact the previous SMSF auditor  -  they had to see all these documents anyway, and should have kept copies.

We have scans of all startup docs for SMSFs that we have audited.
