Please make this clearer.
I have been separated for more than 18 months, but still married and supporting my family and wife financially. If I am separated and living in a different residence but not yet divorced, (ie still married but not in a relationship).
- Do I still have spouse according to the ATO?
- If so, does this also mean that we are not "separated" for purposes of calculating tiers and family income for the Private Health Insurance rebate.
I have found conflicting ATO verified answers in this forum. To be clear, we do not cohabitate and I do not consider that we are "in a relationship".

That's a tricky one because even though you're separated and living apart you've mentioned you're still supporting your wife financially. The purpose for declaring spouse details is so we can work out your family income which is used in other calculations as mentioned. We'll check your situation with our technical team. They might suggest tailored advice but I'll let you know.
