What do you do when an employer has incorrectly included bona fide LAFHA on a payment summary, yet they refuse to fix it & have it not appear?

The first time the LAFHA appeared in Gross Wages. We asked it be removed. The employer re-issued the payment summary but this time the LAFHA sum was down the bottom as an allowance.

We asked again & they did nothing.

We then submitted our tax return as it should have appeared & are now being chased for "Unpaid Taxes" as our tax return does not match what the employer submitted.

Now a fourth time we have asked & they flat out refuse to admit they are wrong (most likely due to a large pending FBT amount they will owe).

At what point does the ATO step in to correct the employer or do we have to take them to court to get this rectified??

We have answered a similar post on our forum, you can view our response here. If amending the previous return has already occurred, you may need to lodge an objection to the outcome and provide evidence to support your claim.

Hopefully the matter is resolved soon.
