I'd like to find out how you confirmed with the ATO that tax was being withheld? Did you contact us by phone and speak with someone about this? What information were you provided with?
It is the case that the employer must complete their section of the TFN declaration form and submit it to us directly, there is no option for the employee to do this.
As you've already seen on our website, employers must lodge completed TFN declaration information to us as part of their business reporting obligations. If you're concerned that your employer isn't fulfilling their tax obligations, we have a tip-off line available that may be of use, and I'll include a link further down.
In terms of being taxed at a higher withholding rate, typically, if a TFN hasn't been provided, the employer may withhold tax at the highest rate. Please keep in mind that if too much tax has been withheld for the financial year, then you would be able to claim this back when you lodge your next tax return.
And just finally, the form takes effect from the first payment the employer makes to you after they've received your form. So if you'd already provided them with a completed declaration form, then the next payment you received after doing this should have reflected the correct amount of withholding.
