We have a client who is a sole trader and has been injured at work. As sole traders are not generally covered under work cover is the sole trader able to claim medical expenses for the injury as a business expenses. We have a PBR for another client that was a director of a company that was able to claim the medical expenses for being injured at work through the company, however due to this client being a sole trader the situation is different and I would like clarification please.
The short answer is no. A sole trader is unable to directly claim back the cost of medical expenses for a work related injury. They are unable to obtain workcover insurance.

So you are saying sole trader hurts themselves and they have no insurance, and cannot claim on insurance. What happens to them?
But a director of a business can claim medical expenses. To me that does not seem right? I would assume the same rules would apply to both. Section 8-1 of the ITAA 1997.
is there a ATO reference to the PBR you speak of ? We have the same situation , director cannot get workers comp , but has signifcant medical expenses
Hi @superioreq,
You'd be best requesting a private ruling. You'll get a legally binding answer.
