We have an income stream through an industry fund. We don't receive a pension and the fund only has a Quest Apartment and a $30K share portfolio I pay $3K in compliance fees which I can't claim

Need to be licensed as an AFSL to answer that. You could ask the accountant about how your tax position would look if the property was transferred to you personally.
