I have someone that i'm looking to hire that has a student visa (subclass 500) and was wanting to know how many hours per week they are allowed to work.

Details -

  • In Aus studying full-time degree
  • This person is currently working in the aged care sector for an approved provider
  • We are in the NDIS space but not a registered NDIS provider
  • The work will fall within the persons study field

Looking to know if this person is eligible to work 20hrs per week or more due to the temporary relaxation of working hours for visa holders?

I also understand that during their holiday times (outside of semester study) they are allowed to work increased hours.

Also, would this person be classed as a Aust resident or Foreign resident for tax purposes by the ATO?

Check out the information on the Home Affairs website. It explains the criteria to work more than 20 hours per week.


There's four tests that can be used to help work out residency status. They are:


  • domicile test
  • 183 day test
  • resides test, and
  • superannuation test

We've also a fantastic tool on our website that helps determine residency status.
