I’ve been working full time as a sponsored with my new employer since May 2021. I realized I paid foreign resident tax purposes instead Australian resident for tax purpose. I worked on residency tax status tool and everything ticked on so I am an Australian resident for tax purpose.


How do I claim back all the money that I paid as foreign resident tax. This might be error from admin as they thought temporary resident is foreign worker for tax purpose. However I worked for 3 years now and intent to stay here longer.


Can someone advice on me about this, please? Cheers, Farissya

Hi @farissya,


If your employer is still withholding taxes at the incorrect rate you'll need to update your information with them. You can do this by providing them with a withholding declaration. When you fill it out, make sure to tick your correct residency status.


To claim back any overpaid tax, you'll need to lodge a tax return for the year. This means you won't be able to get back any of the overpayment until the end of the current financial year. As for previous years, if your employer withheld too much tax, when you lodged your returns it should have been sorted out. When you lodge a tax return for the year, you would have entered in your residency status. If you ticked that you were an Australian resident for tax purposes during these years, we would have seen that your employer overtaxed you and then refunded it. If you need to fix any prior year returns to change your residency status, you'll need to lodge an amendment.
