Dear Concern,

I am writing in regards to the query related to superannuation received.

I used to be a temporary resident in Australia for six years.

I was on student visa when in Australia. I paid every rent, bill and taxes on time, the fees on time and I always been a genuine student. I was pursuing MBA when I came for family visit to my home country. I had one year of visa in my hand. I couldn’t travel back to Australia due to lockdown and border closures. I couldn’t complete my studies, my visa also got expired. A lot of precious time of my career got wasted in just waiting for the border reopening. When borders reopened, my visa had got expired already at that time.

I applied for superannuation fund but lot of tax had been deducted from it. My fund amount was 17,500 approx. and I received 11,500 approx. amount in my account.

I request you to please refund the superannuation fund as much as possible, as I have already suffered alot due to lockdown. My life has turned upside down. I had my dreams that just couldn’t get fulfilled, my studies have left in between.

Australia and other countries have helped a lot of people during the hard times.

I also request you to help me as much as possible and please refund me the rest of the fund.

Kind Regards,

Raj Kiran

Hi @Kiran_grewal59,

We're sorry to hear of what you experienced due to the pandemic.

The tax you paid on your super wouldn't change if you accessed it as a DASP payment. This is determined on whether you were on a WHM visa or a temporary visa.

Once you depart Australia you can only apply for your super once your visa is cancelled or inactive. It's this visa you were on that determines the DASP tax rate. The amount you received tells me you were charged the 35% tax. The WHM tax rate is 65% tax. In that scenario you would've paid $11375 tax.

Unfortunately, there is no refund on DASP tax paid.
