I have been taxed at the highest rate on my entire salary as if it is a second job. It is my only job, I'm out $500 for just one pay. They claim they can't fix it and I just have to wait until next pay to be taxed at the correct rate, and next year for my tax return to access money they have already taken. All the forms I completed indicated this was my only job. What is the law here? I've essentially worked two weeks and got paid for one.

Hi @nichegirl,


If your employer has made an error withholding too much and it's within the current financial year, then they can refund it to you.


Meaning, that you've ticked to claim the tax-free threshold in your TFN declaration and they haven't applied the correct rates.


If not then any excess withholding will be refunded to you in your tax return.

Thank you for replying. It doesn't answer my question though. I know they CAN refund me, are they legally obligated to? Are they legally allowed to withhold it until my next tax refund in 12 months, knowing they taxed me twice on the same earnings?
