Hi,


We paid $182.40 including $3.40 surcharge for a business expense

(purchased pizzas for lunch for all staff) and

received the tax invoice with ABN but it doesn't show anything about GST.


The business is registered for GST according to ABN Lookup.

Pizzas are taxable based on 'GST food and beverage search' on ATO website.



For this case, excluding the surcharge of $3.40 (assuming GST-Free),

can we claim the GST credit? ($179.00 / 11 = $16.27)

If the invoice states Tax Invoice this implies the issuer is GST registered, the other thing to look for on the invoice is the wording such as inclusive, including, includes or plus this would again tell you the total price has GST in it, if this is the case then you can claim the credit.


A surcharge is generally treated as part of the consideration for the supply and where the supply is taxable GST will apply to the surcharge component as well.


If GST has been applied, you would use the total amount of $182.40 and it would be broken down as the following:


Price (ex GST)          $162.42

Surcharge (ex GST)  $   3.40

Subtotal                   $165.82

GST  10%                  $ 16.58

Total                         $182.40


If there is no wording that implies GST has been included even though a tax invoice has been issued it is not safe to assume GST has been applied and you’re not able to claim a GST credit,


The incomplete invoice may be an oversight of the supplier, you can contact them and discuss the invoice, if an error has occurred you can ask for them to issue you with an amended invoice which they must provide to you with 28 days.
