If an employer pays Dad and Partner Leave to an employee, should this be treated as Paid Parental Leave for STP2 reporting, or is it more likely to be Paid Other Leave. Info on the Service Australia website indicates that Dad and Partner leave is an Australian Government payment under the Paid Parental Leave scheme...

So if the employer their own Dad and Partner Leave scheme, would that qualify as Paid Parental Leave?

Hiya @MaryTC

The ATO STP2 Employer Guidance defines "paid parental leave" as paid parental leave 😉 because the ATO refers to leave defined by Fair Work.

The Fair Work Ombudsman defines that "parental leave" entitlements include:

  • maternity leave
  • paternity and partner leave
  • adoption leave
  • special maternity leave
  • a safe job and no safe job leave.

I hope that helps - Deanne
