What are my obligations as an Australian business when you use overseas contractors from Philippines and USA regarding tax or anything else needs to be taken into account. They will be working in their relevant country and doing work from there. They will be providing an invoice for work completed. They are NOT Australian residents and they will not be in Australia at any point.

Hi @Mazperty,

If they don't have an ABN they can look at providing you with a Statement by a supplier. This'll let you know you don't need to withhold tax.

Have a look at the business.gov.au website where it talks about goods and services tax on imported services and digital products.

Hi Carol thank you for your response. Can you elaborate on what you mean about Statement by a supplier. This'll let you know you don't need to withhold tax.

Hi @Mazperty,

A Statement by a Supplier is a form a business or individual that supplies goods or services can complete if they’re not carrying on an enterprise within Australia.

It’s justification for the payer not withholding from the payment to the supplier.

There’s more information and a link to the PDF form on our website.
