I am domiciled in South Africa and have never set foot in Australia. I have applied for a remote position at an Australian company. I will never be required to enter Australia while working for this company.


I will be required to pay income tax in South Africa. Will I need to file a tax return in Australia too? Will I be double taxed in Australia and if so, at what rate? Will I be exempt from paying tax in Australia? What implications does the South Africa & Australia tax treaty have on my situation?

Hi @Malcs1992,


If you're a foreign resident performing the work overseas, the income will be regarded as foreign-sourced, even if it's from an Australian payer. This means there's no requirement for your employer to withhold under PAYGW nor do they have to pay your super. However, both you and your employer may have tax obligations in the country where the work is being performed. You can also check the tax treaty information in regards to this.
