Under the new legislation for FBT exemption for EV's, one eligibility criterion is that the vehicle is "first held and used" after 1 July 2022. I'd be grateful if someone could clarify whether a dealer demonstrator vehicle would meet this criteria where:

  • it was first registered by the dealer as a demonstrator vehicle before June 2022, but
  • it was first sold to a retail customer after 1 July 2022.

Assuming this does meet the criteria, would a demonstrator vehicle which was purchased wholesale by another dealership be eligible if it was first sold retail after July 1 2022?

Hi @ScottfromQLD,


Because the car year held and used the car as a demo it's no longer considered new. The car yard most likely allowed buyers in the market to test drive the car.

"first held and used" after 1 July 2022.

This refers to the entity claiming the exemption. The vehicle could be used or new.

that is the vehicle must have been purchased and used after 1 July 2022.

I’m still a trifle confused here. Could you categorically clarify if the term ‘used’ applies to an ex-demo model? I would be the first private entity to own the car.

Previous responses and the example seem to be subjective.
