I'm helping former UK colleagues to set up their company to do business in Australia. I'm their 'local agent' for dealings with Oz government bodies. So far:

  1. the UK company has been registered in Australia as a Foreign Company
  2. it has a Company TFN and ABRN, Director IDs, and Individual TFNs for the 3 directors

So 3 general questions:

  1. how is GST registration and processing handled for the above? I'm familiarly with doing GST as an sole trader in Australia but not sure if its the same for the company ie just the same as an Australia Limited company
  2. what is the taxation treatment for sales made in Australia? Is this just an Australian Company tax return for Australian derived income.
  3. how would revenue distributions back to the UK directors be handled

Thanks muchly

Hi @BruBo,

There are 2 different types of GST registrations for foreign companies.

  1. simplified
  2. standard

If the company doesn't have an ABN they can use simplified GST.

A company can use standard GST if they -

  • have an ABN.
  • makes sales connected with Australia.
  • need to issue tax invoices.
  • want to claim GST credits.

They'll need to lodge a company tax return. Tax will've been paid before any profits are sent overseas. You might to check UK tax laws what their requirements are.

Check out the information on our website where it talks about non-resident businesses and GST.
