Hi,
I have a question regarding CRS for medical expenses and medical transport.
Whilst the eligibility requirements for compassionate release of super (CRS) are quite comprehensively explained on the ATO website, there is a rather important question that isn't addressed, being whether the timing of when a CRS application is made affects the eligibility.
In other words:
Does it matter if a CRS application is made before or after medical treatment is received ?(please note: I understand that only unpaid medical expenses can be released)
Does it matter if a CRS application is made before, during or after medical transport to an overseas location? In other words, can a CRS application be made if a claimant has already travelled to the treatment destination? (please note: I understand that only unpaid transport costs can be released)
Logically, one would think it doesn't matter when a CRS application is lodged, as this doesn't objectively change the nature of the expenses. Unfortunately this is not expressly stated in writing anywhere to give peace of mind.
Please note that I understand that the ideal situation is that a CRS application is made before medical expenses are incurred to reduce uncertainty and to avoid the risk of not being able to pay the expense. What I am seeking is to know the extent of what the rules allow in situations where treatment or medical transport commences prior to a CRS application being made.
Thank you and kind regards
