Good morning

An overseas client was studying for a Ph.D. at an Australian university from 2015 to 2019. he was working at the university as a tutor on a part-time base. He was sponsored by his government on condition to return back and work in his country.

He finish his study in 2019 and his government made a payment of over $100,000. He decides not to return due to political issues and fear for his life.

His government ask for the money to be paid back. He borrowed money and pay it back in the 2021 and 2022 financial years. during these years he still worked at the university as a tutor but on a full-time base.

The question is, can he claim this money back as study expenses for the 2021 and 2022 financial years?

Many thanks for the extra information.


To claim study expenses, your client needs to meet the normal eligibility criteria. If they believe studying is going to give/gave them the outcome or likely result of an increase in their income in employment opportunities or maintain or increase specific skills or knowledge they use to support tutoring they can look at claiming.


Keep in mind, your client will need to claim the expenses in the year they incurred. This may mean they amend their previous year's tax returns.

Can you provide us with more information, what are their employment duties and courses they are studying?

I contacted the client and I received this response from him.

I pursued a Ph.D. in Engineering and Information Technology at *** from July 3, 2015, to March 18, 2020. During my time as a student, I also had the privilege of working in two important roles at the University: "Tutor" at the Faculty of Engineering and IT and "Administrative Assistant" at *** Housing.

At the Faculty of Engineering and Information Technology (FEIT), the responsibilities of a tutor typically encompass the following:

  • Conducting tutorials: Leading small group tutorial sessions to provide additional support and clarification on course materials.
  • Facilitating discussions: Encouraging student participation, critical thinking, and deeper understanding of the subject matter through engaging discussions.
  • Assisting with problem-solving: Guiding students in applying theoretical concepts to practical scenarios or assignments and helping them develop effective problem-solving techniques.
  • Providing feedback: Reviewing and providing constructive feedback on student's work, including assignments, projects, and assessments, to enhance their understanding and performance.
  • Addressing student queries: Responding to student inquiries related to course content, assignments, and assessments, both during tutorial sessions and through email or online platforms.
  • Grading and assessment: Assisting in grading assignments, exams, and other assessments in accordance with the provided marking criteria to ensure fair and consistent evaluation.
  • Attending training and coordination meetings: Participating in training sessions and meetings organized by the faculty to align teaching approaches, maintain consistency, and address any concerns or updates related to the course.
  • Collaborating with academic staff: Working closely with lecturers or course coordinators to ensure alignment with course objectives, coordinate teaching activities, and provide feedback on student progress.
  • Creating a supportive learning environment: Fostering a positive and inclusive learning environment where students feel comfortable asking questions, sharing ideas, and engaging in discussions while respecting diverse perspectives.
  • Staying updated with course materials: Keeping abreast of course content, assignments, and any changes or updates to ensure accurate and effective delivery of tutorial sessions.

On the other hand, at *** Housing, the role of an administrative assistant involves a diverse range of responsibilities associated with the management and operation of student accommodation. Some of the key tasks undertaken by an administrative assistant at *** Housing include:

  • Front Desk Operations: Managing the front desk and serving as the initial point of contact for students, staff, and visitors. This entails addressing inquiries, providing information, and directing individuals to the appropriate resources or personnel.
  • Student Services Support: Assisting students with various administrative tasks related to their accommodation, such as room assignments, lease agreements, maintenance requests, and billing inquiries. Offering guidance and support to ensure a positive living experience for students.
  • Document Management: Handling documentation and record-keeping processes, including the maintenance of accurate and up-to-date student records, lease agreements, and occupancy information. Ensuring strict confidentiality and compliance with data protection regulations.
  • Room Reservations and Allocations: Managing the room reservation process, coordinating with students, and allocating rooms based on availability and specific requirements. Regularly updating and maintaining the room occupancy database.
  • Reception and Mail Handling: Receiving and distributing mail and packages for residents, notifying them of package arrivals, and maintaining proper documentation and tracking of incoming and outgoing mail.
  • Communication and Correspondence: Assisting with communication efforts by drafting and sending official correspondence to students, staff, and external stakeholders

I also have a similar question. I am a student and at the same time work as a tutor in the University. Can I use my tuition fee for tax reduction?
