Hello,

We are currently in the process of changing our trading name, and also changing our business structure, and wondered if a new ABN was required, or if we are able to keep our existing ABN?

We are currently an Incorporated Association, and we will be moving to a company limited by guarantee.

We are also a not for profit and have PBI status, and want to make sure our exemptions from payroll and income tax will remain in place, as well as our employees having access to salary packaging, up to FBT exempt amount applicable to a PBI, if our company structure changes to a Company Limited by guarantee.

So, there’s a few differences here and you’ve used a few different terms, let’s get this sorted.


An incorporated association can choose to retain its existing ABN and an unincorporated entity can’t when they change their structures to a company.

In these circumstances we usually suggest getting professional advice for such transfers of structure to make sure you have a clean transition. The general answer is yes, its possible you can keep you ABN. You will need to contact ASIC to begin with and make sure you get the structure changed correctly with them.


To update your ABN you will need to contact the ABR in writing at:

You will need to include several things to make it possible to evaluate the change. It will need to have the new name of the company, the ACN, type of company you have transitioned to, if you are requesting to keep your ABN and details to assist in identifying the entity (address, associate info...etc).
