So my employer who I work casually for once a week (the only night they are open each week). I have done for the past 18 months. This employer was a friend before I started here.

Since I have started, they have been nothing but dodgy...

  • They refuse to do pay slips, I have asked numerous times. When I informed them that it was a legal requirement to provide them within 24 hours of payday they literally laughed and said they didn't care.
  • There is no time sheets or clocking in/out system for accurate hours worked
  • They don't pay you for the hours you actually work, only the hours you were rostered - even if you do overtime
  • 95% of the time you don't even know if you're meant to be working until the night before (usually less than 18 hours notice until your shift starts).
  • Payday is fortnightly so it's not like they have a lot to work out to even put on a pay slip,
  • Pays aren't always paid on the day they are due either. Sometimes they can be almost a week late
  • I have just asked about when my group certificate will be uploaded to my gov and they couldn't tell me an answer as they "don't know when they'll be doing them as they can't be bothered right now"

There are about 20-30 other employees of this business who are all in the same boat.. I really don't know what to do. I'm not confident enough to estimate anything based off bank statements. I am tempted to contact fair work but they will know it was from me and I don't want to cause any issues.

Any advice appreciated

You can also report unanimously to fair trading regarding the employer not following employment rules

But if you want to solve your specific problem, you will have to report it to fair trading and chances are your employer is going to know its from you. You will have to do the right thing and report regardless.
