Help!


I recently sold my house and applied for the foreign resident capital gains withholding clearance certificate 3 days after contract signed. House is meant to settle on Friday and I called the ATO for a status update and they said it’s 20 business days and not due to be completed until a week after settlement. They won’t expedite it as they want a level playing field.


What can I do to expedite the processing of this? If it settles before it comes through I’m down a small fortune - to which the ATO shrugged and said ‘yep’.


What are my options? Times running out.


ATO help desk said I need to show financial hardship or family emergency (referred me to QC65010) but this doesn’t seem relevant for a clearance cert. That said, I can demonstrate both but left in the dark as to how to go about this. Again, clock’s ticking.


Any advice welcome.


I’ve approached conveyancer to see if they can delay settlement and waiting a response. Might be problematic as buyer wants to back out on sale and failure to settle may trigger a clause allowing them to walk away.
