Hello.

My wife started a 2nd casual job today, Saturdays only. They say she needs an ABN as they are treating her as a contractor. As far as I am aware, they will not be withholding tax or paying super.

Her 1st job is the same type of work and she is treated as an employee - tax withheld and super paid.

  1. Is it absolutely necessary that she gets an ABN?
  2. Can we forego the ABN and pay whatever tax is owing at the end of the financial year?
  3. Any risks getting an ABN if it is not needed?

Thanks in advance.

Hi @PloysHusband,

When someone asks for an ABN for contract work, they may assume that your wife already has one.

Your wife can use the ABN entitlement tool to determine if she is entitled to an ABN.

Generally, if the income is received without providing an ABN and she is not treated as an employee. There could be no ABN withholding apply.

If your wife applies for an ABN and determines she does not need it, she can cancel the ABN.
