Hi I’ve dissolved from a previous partnership with a business partner that has lodged his own tax without doing the partnerships income and loss for the financial year, when my account has reached out to get him to allow them access to be able to finalise everything to do with the partnership there’s no response.

Personally I can’t lodge my own income tax without him allowing my accountant access to the partnership side of things to finalise my own tax. I want to know what I can do to work around this problem and if I’m obligated to pay his burdens if he’s done his incorrectly, as I have assets and he does not could my person assets be at risk from his negligence?

  • It's a partnership, shouldn't you also have access to the partnership accounts?


If your business partner is the one doing the parntership return, alternative could be to log into ATO online service for business to see the submitted tax return for the partnership? Though it won't be detailed

  • I'm fairly certain partnerships are not a separate legal entity so the risk would be similar to sole trader where your personal assets are at risk

@YellowPotato is right. If the partnership has an ABN and you’re listed as a partner, you should generally be able to access the partnership’s Online services for business account. This would usually only change if you’ve been formally removed as a partner or the partnership has ceased.


A partnership has its own TFN and must lodge an annual partnership tax return showing income, expenses and how the net income or loss is split. If there’s nothing to report for a year, one of the partners may need to phone us to request a nonlodgment.


Each partner must include their share of the partnership’s net income or loss in their own tax return and is responsible for tax on that share. Where there’s no written partnership agreement, income and losses are generally split equally.


If you’re still a current partner, you don’t need the other partner’s permission to lodge the partnership return. You (or your accountant) can lodge it if you have the TFN/ABN and the relevant financial records. If you need info we hold to lodge, you or your tax agent can phone us to discuss what can be released.


If the other partner is refusing to provide internal business records we don’t already have, that’s outside our control and may need to be addressed directly with them or through independent legal advice.
