I will be 61 next month. I work full time in my day time job and have also been working for the last 16 months as a self employed uber delivery driver( around 20 hours a week). My question is if I cease my self employment as an uber driver but continue my full time day job do I meet the criteria for accessing my superannuation?

@Penelopexx

So you're past preservation age, and will cease your business as uber driver.

Does your cessation of business qualify as a condition of release ?

Thats a great question.

I also look forward to reading a correct answer, hopefully with reference to relevant legislation, legal precedent, or other reliable authority. eg Schedule 1 of SIS Regulations.

Not just reference/s to ATO blog page/s.

In my opinion, the TTRIS suggestion from @Taxduck is appropriate, @Penelopexx , given an Uber driver is not generally entitled to employer-provided super. As such, you haven't ceased working for an employer who contributed to your super fund, and accordingly I doubt you've met that particular condition of release.
