Hello,


I have entered into an 'off the plan' contract with a developer to build an apartment. The apartment will not be finished for two years and I would like to spend the period until then saving my money and also accessing the FHSS scheme.


Does having signed this contract to build the apartment with the developer make me ineligible for the scheme?

Hey @Harcs,


Besides meeting eligibility to apply and having eligible contributions, part of the FHSS scheme eligibility is requesting a determination before signing any property contract that gives you an interest in the property.


Off-the-plan purchases and contracts may be:

  • split between land and construction, or
  • combined into one.

It's important to consider the timing of settlement for each part. Example 10 on the General Notice 2024/1 is a good example to review.
